State Specific Question About: MASSACHUSETTS (MA)

Tenant is moving end of the month. Have asked her for her forwarding address - she 'forgets' what it is. Is she legally required to provide me with a forwarding address? --108.20.x.xxx

Take or send a form reminding tenant to forward mail, instructions for cleaning, acknowledge relinquishing possession and any items left behind will be disposed of and billed against security deposit, etc. Then leave a space for where tenant would like security deposit accounting and any money owed to them to be returned. --73.47.xxx.xxx

No, unfortunately they are not required to give you a forwarding address.

When you get ready to send them the accounting for their rents / security monies, etc, just send it to their last know address aka your unit. I send this certified mail, restricted delivery, RRR. This way I get a proof of mailing that shows I complied with the strict MA timeline for accounting for / returning SDs. If they letter comes back to you as undeliverable, DO NOT OPEN it, just put it in their file. Someday if the need arises a judge will open it.

If your accounting shows they owe money & you want to track them down you could try sending them a letter with address correction requested. Presuming you have a rental application from them authorizing you to do a credit / background check, wait a couple of months then run another check to see if their new address shows up. --108.7.xxx.xxx

Send to the last known address, certified mail with receipt request and the post office handle it for forwarding. If it gets sent back to you, do as advised above, file it and don't open it. If tenant contacts you looking for their money I would get new address, Xerox and file the original e envelope with proof of mailing and date mailed. Put the whole unopened envelope in a new bigger envelope and mail again via certified mail to new address. No more obligation on your part. --66.87.xx.xxx
