State Specific Question About: MARYLAND (MD)

I have a month to month lease with an enlisted Military and his spouse. The lease was supposed to be for 3 months and they have been there for over 2 years. I have attempted to take back the property for my personal use, but the tenant refuses to move and keeps sending me rent. Every time the spouse claims he is "deployed." Since the lease was going to be short term, I did not get his contact information at the Base and have had no luck finding his CO or unit. Can someone give me advise on how to resolve the issue without seeing a lawyer to evict them? --104.129.xxx.xxx

You've set up a difficult list of parameters you're willing to work within: no lawyer, no contact with base CO, no deployment orders. Therefore, the helpful advice I can give is limited. Sort of like asking, "Can I swim with a brick tied to my ankle?" Possibly...but very challenging.

All I can say is you can try to evict them on your own as hold-overs, but you better be sure you have your ducks in a row or it won't work. If he is deployed, you'll lose and end up eating the court costs, plus he might counter sue under the Service Members Relief Act and get a lot of money from you.

If I were in your shoes, I'd spend the $250 to get an attorney who knows what he/she is doing. --173.16.xxx.xxx

I would take his/her name to the local base and ask if you can speak with the CO about them, they will likely tell you in 10 minutes if under their platoon, maybe call around to find who the correct contact will be, or you will go to the next branch - when you visited to replace furnace filter or do the basic 6 month checkup what service branch uniform did you see? --76.188.xxx.xxx

The "deployed" spouse may be just that... or he may have left with a new partner 6 months ago.

You have to get the scoop on this guy from the horse's mouth: his commanding officer. I have found them to be nothing but helpful in a situation like this. --141.129.x.xx
