Is there a state or city guideline which dictates how many people can occupy a unit?

1 bedroom apartment=- how many occupants?

2 bedroom apartment unit?

Based on bedroom size HUD has an oversight, your local fire dept may be able to override the HUD sizelines. What we read here seems to be 2 person ina sleeping room with another on the sofabed, check with your fire dept for clarity and smoke detector placement is their specialty while you are in contact. --75.94.xxx.xxx

typically (in my area anyway) they don't (or haven't) limited anything - I would say a 1 bed apartment you can state "max 2 people", a 2 bedroom you can state "max 3 or 4 people". You as an owner can and have the right to limit the number of people in a property ... you CAN NOT say things such as "no kids, married only, etc" ... that's when you get into trouble. --67.246.xx.xx

In my are it depends on the square footage of bedroom. Under 100 ft = 1 person. 100 ft or more = 2 persons. Just had inspection done on a 2 bedroom unit. I hey specified approved for 3 people. --107.77.xx.xx

B.O.C.A. code: 70 sq.ft. bedroom for 1 person, 100 sq. ft. for 2, additional 50 sq. ft. per person after that. Some areas will allow you to consider the liv rm as a bedroom. --71.166.x.xxx

The best place to look is in the town/city ordinances. My town I believe is 150 sq. feet per person of living space so that doesn't count the bathroom. --32.211.xxx.x

It may also be contingent upon what type of dwelling unit it is: Owner occupied, multi-family, boarding home, immediate family occupancy, conventional/unconventional bedrooms, waste water load, garbage load, # of kitchens, parking area, authority having jurisdiction discretion
