State Specific Question About: CALIFORNIA (CA)

We served a 60 day notice to a tenant. The 60 days end on September 6, 2015. Tenant (unauthorized occupants) said they will not move out and will not pay rent, either.

Do I need to serve a 3 Day Notice to Pay on 9/3/2015 for 6 day rent? Do I just evict tenant after September 6, 2015 base on 60 day notice? We did not put any reason on the 60 day notice, but the fact is original tenants moved out and two unknown person moved in without authorization.

Are your calculations correct?

You suggest serving notice on 9/3 for 6 days rent, which would make the tenancy valid until 9/9, not 9/6. And, you don't say what day rent is due.

You can evict for holding over after being served with 60 days notice, at any time after 9/6. You do not need any further notice. You can go to small claims court to try to collect any missing rent (its no longer rent, it is damages).

Are you crazy? You are in California. They to evict someone for anything but unpaid rent and it will take months to evict. What I would do is sent your tenant a 30 day notice that the rent is going up 10% FOR THE EXTRA UNAUTHORIZED OCCUPANT. Still collect the lower rent for this month. But if you don't get the extra 10%, then give them a 3 day notice to pay or quit. Then evict for non payment of the extra percent and have all of the rest of the rents paid..... --173.55.xxx.xx

Robert,

While AW say that he is in CA, he did not say that he is in Los Angeles and under Los Angeles Rent Control.

For those of us NOT under Rent Control, it is no more difficult to evict for holding over than it is to evict for nonpayment of rent. The complaint must be different and the pleading different, but the process is just as quick (or slow, as you like) and just as sure.

If your rent is due on the first of the month, I would serve a 3 Day Notice To Pay Or Quit today. Then, if the rent remains unpaid, file your unlawful detainer on the non-payment of rent. That is faster and easier than the 60 Day eviction.

Or, given the dates, file for both grounds.
