What does SEAMS to be moving mean?
How much notice is required if she's month to month?
I'm still miffed by the SEAMS to be moving? Surly your state requires some type of written notice?

OK she is on a month to month lease. Back on July 12th see emailed me her 60 day notice and that she would be out by Sept 12th. The lease requires a 60 day notice. Since then she has verbally said she was not sure when she was leaving. Now has made comments to my husband she is leaving but really does not state when. In NC I have 30 days to refund deposit and that is why I was wondering about the rent she has paid in advance. She has asked me twice via email that she wants that refunded now. I do not plan on giving anything back till the day she is leaving and her deposit will be returned in the 30 days. At this time I am going on the 60 days notice in writing and will keep the entire month of Septembers rent because what I understand that is common practice not to pro rate the month they leave. --67.238.xxx.xx |

First all notices must be in writing. Second 30 or 60 days notices are from the time the rent is normally due. You don't rent by the day you rent by the month.
she has already reneged on the time frame so get her notice in writing.
Her 60 day notice is no go for sept. or Oct-- its good for November. 60 days from when the rent is normally paid. the 60 days start September 1.
So her rent is paid for an Oct departure. Now do your walk thru and list damages give her a chance to fix items then get whats left of the deposit to the tenant during the 30 day time frame required by law-- not a day sooner.
People out there-- emails and texts and verbals from tenants--- you get burned every time. I'll be your lease has all notices need to be in writing but you went the easy way with email--- easy comes back to bite you.

When the unit is empty of all food, furniture and packages and you have keys this is when the 30 day clock begins on returning the accounting statement of damages with refund or bill, need a new address to send using cert mail - the green card. It would be a smart thing to arrange a pre-moveout inspection so you all have an idea of anything they need to do and this will better prepare you for a quicker turnover, if there are holes in walls take photos, appliances sitting in a pool of filthy food - lotsa cleaning bux gonne be used to restore to movein or simply habitable condition. No keys and the rent clock runs, that is the simple way to remember this, just like a restraining order it is simply a piece of paper that describes where the rubber should meet the road. --75.94.xxx.xxx |

It really doesn't matter if it's email or pen on paper. Email notice is considered "in writing."
Start communicating with her. Get her to CONFIRM the day she will be completely OUT with the place CLEAN and ready to occupy, and when keys will be returned.
Until you have that, she is incurring rent due, so you can't return pre-paid rent until she is OUT.
NC requires 30 day accounting of SD - in certain cases (such as when you do not have a final accounting of damages or are waiting for quotes) you can extend it to 60 days: you send a preliminary at 30 days and state you will have the final in another 30.
Since the SD is held separately from rent, it is an entirely separate process. --108.56.xxx.xxx |
