State Specific Question About: CALIFORNIA (CA)

We installed new carpet when tenant moved-in in 03/2014. They moved out on 7/31/2015. Living room carept has a big, red stain about 8" x 8". Nothing clean it off.

How do I charge tenant? I talked to other managers. They said new carpet cost x (67/84) base on 7 yrs of carpet life. (17 months of occupancy months, 84 -17 =64 month carpet life left)

Turn up the carpet and check the floor and padding, most carpet is a stink and stain magnet and the soaking thru is the more expensive problem. The math you show has been used a long time - you must get the estimates into the accounting statement before your time runs out on the damage deposit. --75.94.xxx.xxx

Probably Kool Aid. Carpet cleaner told me that red is hardest to get out. I would get a steam cleaner to put that in writing on the bill and then charge the tenant for an entire new room of carpeting on their security. I started using darker browns and olefin Berber because olefin carpets are more cleanable. The fibers don't absorb stains. --73.33.xxx.xxx

Yup, red kool-aid. That's what my carpet cleaner said the red stain likely was, too.

For those still using carpet you might consider using Lifeproof carpet. Lifeproof carpet has the stain resistance built right into the fiber, so it doesn't get washed out when you clean it. More expensive, but it would be significantly more resistant to this type of staining. --64.222.xxx.xxx

Thank you thank you thank you for reminding me why we no longer use carpet!

Pro steam cleaners have a product called Red Out which can "help".

Me? My lease is clear so I never have to anguish over this again: Replacement cost on all repairs.

Everything is negotiable. The resident knows they have a problem. Work it out and get them to sign that they agree to the charges.

AW,

Lease says: All repairs to tenant caused damage are billed at replacement cost.

My lease then includes a LONG list of STANDARD CLEANING AND REPAIR COSTS.

Carpet is billed at $3/sf to replace. $50 for each repair to the carpet such as tears & animal digs.

(just a heads up if you don't already know: my CA LL friends on this forum remind me everyday how LL/Tenant laws are crazy in Cali.My overall advice is

Everything is negotiable. Talk to the res.

and Gotta know YOUR judge in case it goes to court. Jusge are independent thinkers and often have their own policies independent of the law.)

Be bold and stand up for your investment. No one else will so it's gotta be YOU!
