State Specific Question About: OHIO (OH) Help! I have my first set of tenants from hell. literally. He moved her in, without permssion, was supposed to do application. Did not. instead she has forged my name on a false lease. I gave them 30 days to vacate. they didn't, nor did they pay any rent. instead they started complaining about all these things wrong with the apartment and threatened turning me into all kinds of agencies if not repaired. damage they did of course like ripping off handles to stove, breaking window. which they now refuse access to repair. meanwhile, they turn me into a bunch of agencies, fair housing, code people, fire marshal, you name it. they approach me and ask me to sign received their request to move out in sept. I am receiving it but not agreeing, especially since you haven't paid anything. they said they're sorry for not leaving and will pay. but this is before I knew they were calling every agency in the book. My friend/maintenance guy was there as witness. skip forward 2 weeks. they started threatnening harrassming me, stalking taking pictures. I made police report, but they're pretty indifferent. i file in court eviction hearing. get to court date, they told judge they paid cash, and never got any eviction 30 day notice. he refuses my documents of anything. says he'll make decision after lunch. I just heard from clerk deny my eviction. I am guessing because supposingly they paid rent in July they claimed. They admit no rent paid in August but not their fault because they tried but couldn't put it in escrow. of course, they never offered me rent either.
now they are squatting in my house. I haven't received rent in 2 months, and not working because of a recent injury. I don't know what to do? Should I give them a 72 hour pay or quit for August? and then if they don't pay, file another eviction hearing? $136 each time? they say they aren't leaving till sept. 5th. by the time another hearing happens, it'll be the end of the month.
meanwhile they busted up their apartment, and the code guy wants it fixed but of course they won't allow access to do so. He knows of the damage, because they did it, and then called him to complain.
should I give them another 30 day notice, and start all over, just incase they don't plan on actually going anywhere??? I don't want them indefinitely squatting, me paying the utilities, and them continuing to live here forever.
worst yet, I live in one of the apartment with my kid, so i am at their mercy from harrassment, and its making me crazy finding new stuff they are messing up around the property on a daily basis and taking our pictures.
last weekend he was standing at my kids window taking pictures inward, but the police say we can't prove he was doing it, he says he's walking his dog.....by her window.... the other end of where he should be on the property.
I am broke, and besides more crying don't know what to do???? HELP experts please!
I know a lawyer would help a whole lot, but that takes money that doesn't exist.
My other unit is empty from a overnight moveout that left it a mess and I've been working for 2 weeks to make it habitable and spent alot of money recovering it.
I haven't paid any bills this month because between no work, and no paying tenants, no money is coming in.

You need to start doing research your court system asap! File the forms yourself. Landlord/tenant disputes are usually small claims style and an attorney is not generally needed. Get rid of these people asap. I would not trust their word that they are moving out since they have already proven to you numerous times that they cannot keep their work. If it were me, I would file whatever papers need to get filed NOW.
In addition, if they start damaging stuff on your property and cause destruction, I would inform them that you intend to have them arrested for any intentional damages they cause. --209.255.xxx.xxx |

It is going to cost your more to do it yourself. They have already proved they are more knowledgeable of the court system than you are. You are behind the curve. You can continue to learn at your expense or you can hire a specialist that will end the non-sense.
In the mean time. Offer cash for keys. If you are out like you promised, I'll pay you $X,XXX.00. You need to make it more attractive to leave than stay. You might tell them you are hiring a lawyer to put a stop to their nonsense and you are offering them slightly less than what it will cost you to throw them out. If they don't take this one time offer, you take them to the wall.

I wish I had any money to pay an attorney to get rid of these cons, but attorneys don't work for free, and until I fill the other unit, I have nothing coming in as money, no other job.The broken and crushed foot has hindered working.
You are definitely right, they are pros at this. I'm trying to research now the answer.
Since they did admit to not paying rent in August, I am thinking I should give them a 3 day notice to quit or pay for August. Then give them a 30 day to terminate? I have to go to the court house tomorrow and see if they'll give me a copy of the judge's decision. the clerk wouldn't tell me over the phone, and said they have to mail it to me. they are very slow here, and that could be a couple of weeks from now.
I am planning on date stamping pics of the property now, so when they continue to tear it up, I'll have proof of the condition.
I have to think what to tell the code guy because he even thought they'd be out, and then I could comply with fixing what they messed up.
I like the idea of vandelism charges. If the police will bother. they didnt take me seriously when I made a report of him standing outside my daughter's window taking pictures.because the phone he showed them didn't have anything on it. The police never considered he wasn't using that phone to play creeper.
My kid is scared of them. so for now she won't go outside without me. NOt fun. LIke I said if I had money, I'd pay someone to get rid of them, but I have nothing to pay for a retainer.
Anyway, I am going to keep trying to find the answer to this.

Contact a service processing company may have a recommendation for a company that will do all the eviction paperwork filing for you - so that it is done properly and with the correct timing. You are stuck we say in the repair business, you have some good parts but no frame to hold it together, you opened for business without the knowledge of the tenant laws at least the state laws, I suggest you print out your local tenant laws and place into a 3ring binder, the turn the bookover and put OH 5321 the tenant laws. Now you need to know what timeline to follow for the eviction, you could go to observe housing court for a few months as you cannot afford an atty, by the way this housing stuff requires an eviction service - no other legal system is like this, regular law people will file motions taking 3-4-5 more months to get out someone you should be able to do in 30 days or less,OH is a 30 day state, I have done some in 26 days. So find out whenyour court sessions are held for unlawful detainer and go study, take a lot of notes, you need tobeat the inspector who will tie up your place with moredelays getting corrections made to the property.

What do you mean beat the inspector. They called him, invitation inside and he wrote a bunch of stuff to do, most of it little stuff. But only a month to do all of the requirements, so it is a challenge.
Any suggestions how to deal with and get them out of my life quickly is greatly appreciated.

Remember problem tenants get free legal advise from the government funded tenancy advocate groups on how to play the no rent game. First off contact a landlords association where there are listings on this site or google. Next keep records of any repairs done to the rental unit dates and times. As long as the rental unit is minimum standards no loose plaster or missing tiles along with the hot water tank and plumbing work then the rental is acceptable. In future never allow anyone in the rental apartment or house without running a thorough credit check on all adult applicants. This avoids a lot of problem tenants who look for inexperienced rental housing providers who hand out keys with a hand shake. If one wants to learn from the school of hard knocks or learn from experienced people a landlords association will be the best solution. Whatever you do, once the dust settles, re-vamp your screening process before you start trying to re-rent those two units. If you aren't doing credit reports, get set up to do them.
These tenants didn't just start pulling this with you for the first time--they've done it to others and you missed warning signs during the application process.

The condition of the apartment was impeccable, freshly renovated... until they got ahold of it. Even the inspector acknowledge that they were messing insidING means exterior needs washing. He wants to inspect the basement and should have nothing stored inside, it. That's my only problem. I have storage and landlord stuff in there. Gonna move it to a shed.
Back to issue of the tenant. He came back with clean record, and credit. She appeared later, never added to rental agreement. I gave them an application for her, but instead of applying she moved in. I gave them 30 days notice to vacate, and that's when they got nasty ripping up my place and calling all the agencies on me, much of it was their damage.

You need to check with inspector and ask if any violation requires rent into escrow and if you get an extension because the tenant are not allowing acess for these repairs, tell him/her you are trying to evict for non payment, if not a escrow repair then file and give the inspector name and number - have judge pause and call to verify you are not making up any story, wait and wrap duct tape over you mouth so the tenant can not make you say something stupid that will cause your case to go sour, I never have been to summit county court so I do not have any precious tips however if you feel inclined to visit a cleveland based group for other support they meet next wed just off 480 and ridge at golden corral about 530, you have to buy dinner and there is a small fee for visitors, you get over 2 hours of info, there may be a lady from summit there with a bit of info.
Eviction service is a lawyer who you see there going up and her/his cases are moving along quickly, follow to the hallway and ask for a card and if they can do a flat fee eviction, just a little north in my areas the flat fee is about 350-400, both first and second cause. I realize that this sounds like a lot of crap, but the older ones are of a different breed. Ambulance chasing was not their game. some of them still refuse to advertise. Hello Ms Sara, my advice is to cut your loss short, offer them not to charge back rent if they leave in 3 to 7 days. Or they will risk to have to paid back rent and the cost of attorney if they loose. Yes you will loose some moneys but you will save future loose income, attorney and courts cost. And more important you and your kid will have mental peace, I know that it hurts making this kinds of mistakes, but learn the lessons of it, like next time take pictures or video of the property the same day you give a new tenants the key, and make them write their name in a inspections declaring the conditions of the property.

If you can't afford the $500-$1,000 that it will cost for an attorney then you don't have enough funds to operate a rental property. If you don't hire an attorney, this situation is going to cost you much more money in lost rent and damages before it is done.
You need to borrow the money and hire an attorney. Then once this situation is behind you, you need to come up with cash reserves if you plan to keep landlording. Otherwise you'll be right back in a similar situation with another tenant or some big repair. --50.169.xx.xx |

They met just this past August 12th but I would call the President and some other people of the group (see the contact us) just to see if they can give you some insight as to how to proceed and how your court works. They might be short on time as many are but since you don't have a lot of money they might be able to give some great suggestions. Thank you to everyone with positive solutions and empathy for my problems. For those of you who just scolded me, well i am trying my best. Those who made comments when I mentioned crying, well if your teenager was being harrassed, by your tenants and you were helpless for at least a moment you would be overwelmed too.
As to selling, I've considered this, but it wouldn't be an overnight solution. I would have thought more encouragement on that one, because even the experts started off somewhere in time, and learned from experience, and sometimes mistakes.
As to this couple. He came back with a clean record, easily affording rent, with it being only 25% of his income. No evictions filed, owned his own home 10 years prior to divorce. Same job 15 years. good credit. He moved in due to divorce. No criminal. quiet before she appeared.
She on the other hand is a different story. She appeared later as a new girlfriend. She does have 3 court evictions in 5 years. She is the brains behind the operation tenant from hell. She's been taking pictures of every thing we've been doing on the property, even when we were sorting out the storage and garage last spring, pictures of everything. pictures of materials temporarily sitting in front of the stairs for an hour before they went up the stairs into a vacant unit. everything and anything, and unbeknownst to me till this week. She's a pro, obviously. I think she had the code people on speed dial. Threatened to call them, and next day they were there. She also turns on the tears in less than 5 seconds to get attention. She's so good at it, that the maintenance/repair guy I hire from time to time, almost started buying it, till I called him away, and he'd already knew she was up to no good. Yep,an academy award winner. How can some anticipate their single tenant would find a new girlfriend from hell on craigslist, after he's moved-in? Not sure where my mistake was in this.
As to cash flow, no one warns a new investor about how much reserve is needed. It seems like a good idea. Live in one, rent out the other couple. Tenants pay, thus paying for the cost of the bills, etc. after a while, save up, to buy more,and/or a SF for self. The idea seems good. but application is different, when nasty people move in, and you can't get away from them, and they become destructive, and don't pay. And yes, to be honest, I am not used to low quality people, and dealing with them, and my mind doesn't think they way they do, to anticipate how ugly they behave and how to handle it. its a cultural shock to have to deal with nasty. Maybe the rest of you are tuff, or understand their mentality. But, if one isn't experienced with this kind of people, and thinking,how does one anticipate or be able to read them that it'd happen. Him seemed like a good tenant candidate. her, never would I have rented to her, just upon first meeting, it was obvious she was trouble walking. But, then I didn't rent to her, she was an unauthorized addition.
Perhaps I should never have bought this property, or even been a landlord, and the skeptics on here, might be right. But, I have it now. and I have to do my best with the situation.
buy a property with multiple units, live in one, then rent out the others, in theory seems like a great idea. Pay it off and bills off, then buy more property and a SF for self.
As to income and reserves. I read a bit of critism on this one. As a newbie, and new property owner, there is no Manuel handed out with the deed, and magic place that we just happen upon that tells us about the ins and outs of landlording and how much reserve one might need.(well except this website, that I've found over the recently). But even finding this forum, wasn't instantaneously.)
I had about 8k, until I lost a job due to a horrible accident, that put me out of work for 8 months,(yes, I am suing the party responsible,but that takes time to recover damages, and they don't pay your cost of living expenses in the interim)
Add,some non-paying destructive, nasty tenants, to the mix, and well, life isn't so easy. So, my reserve was used to live on. So yes, i have no cushion money. Not for lack of trying.
Anyone want to buy my building for a fair price, in Ohio,is welcome to make an offer. Any reasonable offer, and I am very inclined to accept.
Realistically, accepting some low ball offer for this place while being in a panic mode is not wisdom, so I can't entertain that idea. However, if I could get a decent offer, I believe I might sell.
Landlording is a learning curve I have come to realize.Maybe I'll do better in the future, or maybe some of you are right and I am not cut out for this.

Sara - Are you using an attorney to sue the party that caused the accident? If so, why don't you ask the attorney that is handling that to do the eviction. Usually the general practice attorneys at least have some working knowledge of tenant/landlord law. Also, I would argue with the inspector that girlfriend from hell has no legal right of possession to be in the apartment and therefore has no legal right to call any issues on you. --32.211.xxx.x |

Sara, I urge you too look for a senior attorney, perhaps the attorney that is suing over the accident you were involved in can point you in the right direction. Most of these senior attorneys that are 70+ want to help their clients, and by this time they have their money made. They will be inclined to assist you without payment up front. "As to this couple. He came back with a clean record, easily affording rent, with it being only 25% of his income. No evictions filed, owned his own home 10 years prior to divorce. Same job 15 years. good credit. He moved in due to divorce. No criminal. quiet before she appeared.
She on the other hand is a different story. She appeared later as a new girlfriend. She does have 3 court evictions in 5 years."
It is a bit odd for someone to do a 180 in behavior as the male tenant did. Is it possible he got involved with drugs after he met her? That would explain a lot.
Or maybe he was never who he presented himself as? Identity theft? Yes it's a bit farfetched but maybe this couple are both con artists who were together from the beginning.

Hello everyone,
God is good! Believe it or not, the money just arrived to pay for the lawyer, most unexpectedly! My daughter was gifted a $1000 toward he school books, which I had already paid for in advance for the new academic year. So, we can use the check for the lawyer! He's planning on garnishing his wages for the damages. Yes, he has a real job, she doesn't. And its doubtful he'll leave it since he's been there for years.
He's also a member of the landlord association in our town, and first thing he did is suggest I attend the meetings.
Well, we are on our way out of this mess. Thank you all for advice, encouragement, and empathy!
After all this, I'll be a stronger better, more informed landlord!
