State Specific Question About: FLORIDA (FL)

Hi, I have a tenant who I want out for a history of paying late. Even with late fees, it is time for them to move. The tenant has been given a three day notice, and the tenant sent partial rent. If I want the eviction to continue, can I put the funds already sent to me into the court and continue the eviction case? If I give the tenant a 30 day notice, I will probably have to evict anyway because they cannot save up to move. I would like to do this in the shortest timeframe. Has anyone received partial rent and actually put the funds into the court? If I give another 3 day notice for the remainder of the rent and the late fees, it just delays the inevitable. In Ohio if it is a check or money order I just hold on to it till the eviction court case. Our court will make you give it back to the tenant at that time. --198.251.xx.xx

I wish I could offer better help but your system is very different than mine.

I'd start here:

If you want them out simply end your MTM agreement.

Did you serve proper notice to them stating the lease will will end the MTM lease on ____(date) and they need to find alternate housing as of ____(date)?

Id LATE the only issue?

We've been doing ZERO TOLERANCE on lates for a year now. Looking back, the problem was not the res, it was ME! *I* was ALLOWING them to pay late so they did.

Residents pay late because landlords have taught them it's OK. No consequences. Many don't even enforce late fees.

Get firm on payment and you might avoid a turnover.

Follow the law but this sounds like it has been going on for too long, send the non renewal letter and if they give you a fuss remind them that holdover is gonna hurt even more then the hurt they are in!! --71.1.xx.xxx
