State Specific Question About: PENNSYLVANIA (PA)

I will be advertising a room for rent.

I own the home, Cape Cod Style. My son is responsible for paying all utlities (oil, electric, water, taxes, etc) and lives in one of three bedrooms. He has a roommate in the second bedroom who pays $500 per month all inclusive.

Third bedroom is upstairs is the largest of the three and will be asking $600 for one person, $700 for second person. Room is all inclusive, including washer, dryer, full use of living room, dining room and kitchen. House is a 5 minute walk to train station to downtown Philadelphia or Trenton NJ and local bus stop.

Can I advertise for adults over 21 only? Or is this considered discrimination? I have tried to research the q&a here but no success.

Is there a reason why your son and his roommate aren't able to come up with a third person on their own? From school, from work, from word-of-mouth?

Legally, everyone who lives in that house is going to be a tenant. But people looking for roommates can legally discriminate in ways that landlords looking for tenants cannot. --209.33.x.xxx

Your son can--I don't want to say "discriminate" but he has more leeway in determining compatability in his private home than you would be allowed to renting a house out to tenants. Maybe this is an ad he should run instead of you. Also there are tons of roommate matching sites now. They should check that out because they could weed through a lot of applicants pretty rapidly. --75.177.xxx.xxx

Ellen,

Basic Fair Housing Law says you cannot state an age. By default, they must be 18+ to sign a lease contract.

Also, be aware of local zoning. MY city governs how many non-related people can live in a house.

Locally, with separate leases, this would be considered a multi-family 3-plex. Might not be allowed in a single family residential zoning.
