State Specific Question About: MAINE (ME) I have a medical marijuana caregiver who wants to rent my SFH here in Maine where medical pot is legal. I am looking for a MTM tenant as I would rather sell the property. Do I have to rent to them?

I do have a non-smoking policy. As "caregivers," these folks extract the oils from the plants and provide them "legally," to qualified medical marijuana patients. I am renting the property as the sale is taking longer than anticipated. It would be a MTM so, should it sell, I can give the tenants a notice. I just want to be sure that I'm not breaking any laws by deciding not to rent to these people. --74.65.xxx.xxx |

Would they be using it as a grow house? The grow houses cause lots of mold damage because of the heat from the grow lights and the humidity from watering the plants. I would also be concerned that extracting the oils might involve volatile chemicals that would pose a fire hazard. I would not rent to them. My rental agreement has a clause in it that precludes running a business from my apartments. The use is for RESIDENTIAL only. Your lease has that same clause, right? --98.145.xx.xxx |

In Maine, a "Medical" marijuana caregiver can grow and sell a limited amount of marijuana to "certified" medical marijuana patients who don't want to grow for themselves or go to a legal MM dispensory.
The whole business has an oily stain reputation. The newspapers here regularly publish stories of these caregivers growing excessive amount of MM, selling to non-certified atients (your regular garden-variety potheads) possessing and selling other drugs, etc. Any yokel can get "certified" as a marijuna patient by quack doctors who sell their license to support this drug trade. --184.153.xxx.xxx |

I remember one in CA I went to a doctor that advertised prescription refills in the paper for $50. That's like 1/3 what my doctor charged for a visit. So I went down - they ONLY did marijuana refills. So I could be a pot head but I couldn't get a simple migraine med refilled without paying $150 to a different quack.

I do not believe you have to rent to MM grower, though can't answer 100% definitively. In the state of Maine you can declare your property smoke free. I have to wonder if they are growing pot, if they are smoking other substances.
It is my understanding that growing pot can damage your building. High humidity levels and a lot of electricity used.
Quite frankly, this sounds like a subpar tenant. Run the credit check, background check, 2 previous landlords. I suspect you can easily find a reason to deny.
