State Specific Question About: MASSACHUSETTS (MA)

I collected a deposit from my tenent and now she's ready to move out. I noticed after inspecting the apartment that the carpet was very dirty and that cleaning it wasn't going to do the job. My question is am I able to use her deposit to clean or replace the carpet and do I have legal standing to do it? What information would i need to collect in order to justify this? Tell me, have you a completed move-in fform and possibly before and after photos?

I'd give a pro cleaner a chance and then ask him to confirm in wrriting that this failed to rectify the issue. THEN use that and charge maybe half of the new carpet (depeends on its age - not wure what's the normal life of a carrpet in an RENTAL?) *** Somehow, LL's blinds and carpet lasts decades. Say it was 4 years old, then I would charge the cleaning attempt plus say 20% of replaceement cost. OR contact tenant and offer to go streigght to replacing it. --113.22.xxx.xxx

Unless you followed all the MA security deposit laws, I would not deduct. And if you do not know what they are, then you didnt follow. But if you did, best to charge a cleaning fee to clean carpet. I hope you have before and after pictures and video. YOu also have to deprecate the carpet, you can not chg them 100% for a new carpet to replace say a 7 yr old carpet. and BTW get rid of carpets. --108.49.xxx.xx
