State Specific Question About: MISSOURI (MO)

If the lease states that tenants are responsible for clearing gutters and uncleared gutters causes water damage, are the tenants responsible for that damage? --24.107.xxx.xxx

The lease states that the tenants are to keep gutters clear. They have not done so and heavy rains have caused some damage to the plaster inside due to the rain not being able to drain down the gutters properly. It just ran down the side of the brick and seeped inside. --107.77.xx.xxx

It's the LL's responsibility. In fact, when we used to have Sec. 8 one of the inspectors wrote up gutters need to be cleaned as a violation.

John, if its in the lease,then they are responsible, but if you think they're going to do it, you're a dreamer. It's better you do it, or have it done by someone who does that type of thing. A very close friend of mine ,set up a ladder at his own house, a regular ranch. The ladder slid and he took a tumble. He's now paralyzed from the waist down. When it happened he was in his early 50 ies. He's now in a wheelchair and starting to get early Alzheimer's. Its not worth the bother. If you have a power washer ,there's an attachment you can get to do gutters just standing on the ground. America is a great country? Charlie................................... --70.215.xx.xxx

Every lease for a house that I've ever signed as a tenant has stated that I was responsible for gutters. And we have always cleaned them, usually twice per year. But we are likely the exception to the rule since we have 2 rentals of our own.

But that's beside the point. Depends on what the laws in your state provide for. I think I'd call them and let them know what happened and why. Ask them what they think would be a fair resolution. If they're still in the house, they may offer to do the repairs themselves, which is be fine with. If they do it wrong, it's not going to cost you any add'l money to fix it. --166.137.xxx.xx
