State Specific Question About: VIRGINIA (VA)
Can a landlord charge for their labor if they do repairs?
can you go to court with just estimates of damage repair cost or does all the repairs have to be done prior to court hearing. (We would need money from tenant to be able to pay for expense of door)

Hi AM,
As with all things, "it depends..."
It depends on your state laws.
It depends on your local judge/magistrate.
A practice I've found that works well is to get an estimate of the repair cost (including parts and labor) from a reputable local contractor. Take that to court to support your charge, then later you can decide if you want to hire it done or DIY.
I recommend hiring it done though. Your habits/actions will form who you are. Do you want to be a door fixer/general contractor or a real estate investor? --173.16.xxx.xxx |

Where i live no. Landlord doesn't get paid for their labor. You get paid every month. My sister does my labor, she bills me via statement and i pay her.
Where i live you have to incured the expense. An estimate is just that, no damages, no expense, no money changed hands. If it truely needs to be done get it done, incure the expense, now you have an expense for damages. Proof.
I would not go to court with What appears and is what you write. Put the repairs on a charge card do something to help yourself.

I went to court on this issue. A tenant's child was playing ball inside their apartment broke a window and screen. After the window broke, the child's mother screamed at their son for 20 minutes, telling him she would have to pay for the screen and window repair.
I got calls from other tenants about the mothers loud fight with her son over the broken window.
A few days later while collecting rents my tenant lied and said someone through a rock and broke the window and screen. I could see the glass was pushed out, not in and it was obvious the tenant had caused the damage.
So I offered to replace the window glass and re-screen the screen for my costs, no labor, a round $25. The refused to pay. I then wrote them a letter that because they refused to pay my cost, and I'm a licensed contractor, I will then have to farm out this job to licensed glass and screen shop, then bill the tenants for the repair, around $125. Then If not paid within 30 days, I would file an eviction. The tenant still didn't pay and I got a local hardware store with window and screen service to effect the repairs. I billed the tenants then filed in small claims court.
Had I had my own company do the work and had my buildings general account pay my invoice to my construction company, the Judge would have given me part of my requested charge. About half of my normal billing price.
But since I got an outside contractor to do the work, I got a full judgement against my tenant. --173.55.xxx.xx |

Ask some local LLs who are experienced with YOUR judge.
My lease is clear: Standard Cleaning and Repair Costs are listed in the lease. No need IN MY COURT for receipts, bills, etc.
You can type up such a list and include it with your bill to the resident and your court papers, calling it your Standard Policy.
Have GOOD photos, printed, to show the damage and NEED for repairs.

Thank you all for your replies. I will try to ask an attorney. We do all our own work being ex-contractors. Its easier than trying to find someone to do it and then half the time they don't show up. Good idea about putting it right in the contract.
Our contract does state we can charge for labor but does not say if we as the landlords can. --24.245.xxx.xx |
