State Specific Question About: MARYLAND (MD)

My air conditioning unit is under repair from the Home Owner's Warranty - American Home Sheild. I have been going back and forth with them that when they fix the unit it's out of freon again in the next 6 months. The work is only warrantied for 3 months, any past that is a new problem. Instead of fixing they problem I am being told I need a leak test, which we know it leaks because the company has been out 7 times in the last two years for the freon. The HVAC company turned the system off because it was frozen and left if off, my tenants have been in the house with no air for 1 week, the hottest week. While this tenant is a real pain in the neck and doesn't ever pay on time, I have been fighting to get this problem fixed. Do I have to put her in a hotel because of no air, I know that if there's no heat I have to make provisions but is there something specific about providing air. It was working fine, with the exception of the 7 times I had to get it charged again and she has been there for two years now. Any advise would be appreciated. --56.0.xxx.xx

Out of curiosity, have they checked the joint solders on the panels? I had a service call recently where we thought the freon was the issue, but it turned out some of the joint solders had failed. It might not be the same thing, since your A/C seems to limp along for six months rather than failing immediately, but it might be something to check.

You guys have been having highs in the low/mid 80's? I might give her some box fans to keep the air moving, but those temperatures aren't hotel-worthy. In TX, it's just open-the-windows-and-turn-the-fans-on weather. --209.33.x.xxx

Thanks everyone. I don't have the funds to replace the unit on my own, this tenant has always been late and the late fee that I charge doesn't equal the late fee the mortgage company charges.

Anyway, she wanted to be there when the AC company came so I made the appointment around her schedule as I have done in the past at her request, which doesn't hurt me any because she is there the cost of the HOW is paid by me before they go out.

She didn't make it in time and they company left so I had to reschedule that's why it's been a week. I told her to use the renter's insurance and they would pay living expenses for her while she is waiting on new date for repair but she still doesn't have renter's insurance.

I have gone around with the warranty people to replace the system and they want to do a leak test before they make any decisions. Also to make matters worse, the tenant would not open any windows and keeps the house shut tight.

I put two window units in the house but again my question is do I have to provide a hotel if the air is not working? I looked online at some of the legal sites and they seem to think not, but I would like to ask those who know the situation first hand. Thanks. --73.201.xxx.xxx

Once you provided the window units you are off the hook, I would ask the warranty folks why they have missed this leak 7 times? Should have fixed it properly the second time, would the staff at blah-blah warranty ask the same questions? How about the service vehicle? broke down 7 times in 2 years?

Basically you need to be sure you are getting a new tech or you are still drinking the same poison, the season is high demand right now but you should get an outside opinion. Save up for a replacement or at least an honest service person. --75.94.xxx.xxx
