State Specific Question About: SOUTH CAROLINA (SC)

We recently moved out of a home unexpectedly after only a year of rental (owners decided to move back in) The property manager is trying to keep all of our security deposit. The reason is that he said they had to go in and do cleaning (even though we paid to have the carpet professionally clean and I clean really well) The only thing I did not do is take the blinds down and wash them instead of just dusting. Also, that there was more than normal wear and tear to the paint on the walls. The paint on the walls was a single coat of flat paint. There were only three places where things beyond dust or a minor scuff. 1 An older TV rubbed up against the wall and left a black mark 2 A chair rubbed against the wall and left a line of scuff mark 3 the movers knocked over a drink and there were 4 drip marks on the wall. I tried to wipe down the walls but due to the finish of the paint any attempt to wash the walls cause the paint to completely rub off. We are only renting because we have had to move several times and still have properties that we are renting. I am so upset because I know as a rental owner, the quality of the materials used greatly affect the durability of the product and I am being held responsible for the owner's cheap choices. I have limited experience, but one thing that stands out to me is that LL are responsible for painting when a tenant moves out.

I believe the LL can demand the walls be in proper shape in preparation for paint (all holes be filled, etc) but when a tenant moves out, the LL is required by law to repaint.

I never heard of LL in our state to be required by law to paint - it's not so. But there is not much you can do.

If you have anything documented - pictures, receipts from carpet cleaners and such, you can try to go to small claims... --24.74.xxx.xx

Matt.. we are talking about SC, not Fl..

I too would strongly doubt either state requires a LL

to paint each time a tenant moves.. out..

But perhaps you check for FL and Christy.. you check SC statutes also on this site.. and see if that is correct or note..

There is no law in South Carolina that requires a landlord to repaint each time a tenant moves out.

The landlord is claiming damages above normal wear and tear.

I had a majistrate tell me painting should be done between tenants and would not allow paint costs as a damage deduction, I appealed and took in several paint cans - the el-cheapo paint that covered like koolaid offered a 10 year warranty but the namebrands all had 20 or more year warranty, she allowed labor but not the actual paint because I could not prove what paint was used prior to move-in, so now we have pictures with the SW, Glidden, Behr or other name brand paint and have not had that problem since. --75.94.xxx.xxx
