State Specific Question About: FLORIDA (FL)

The tenants allowed a relative to stay AFTER he was removed from the lease. Now he will not leave. He may not have any income.

He pays nothing. They want him gone.

Who's responcibility is it to make him leave?

What options exist to get him to leave. --50.88.xxx.xxx

That is not your problem, your concern is that the rent is paid.Do not let them drag you into the drama.I had a woman tell me her husband doesn't help with the bills and hits her and wanted me to kick him out,I told her when I do an eviction everyone goes, she never told me about her personal problems again.A few months ago he had a stroke and died, she is a happier person and her finances seem to be better now but it is not my problem so I don't want to hear about it. --24.92.xx.xx

Give the tenant permission to change the locks when the uninvited guest is not at home. Let it be their doing. --64.197.xx.xx

Contact a landlords association where google to find one near the rental to see what legally can be done about the squatter. Start on this right away as things will only get worse. Now not only is the arrears of rent but also damage done to the rental home or apartment. The tenant may have received money from the squatter. If one knows where the tenant has moved to then tell the tenant you are going to take them to small claims court for arrears and damage done to the rental. Tenants are responsible for damage done by invited guests. --74.220.xxx.xx

Wait! Don't give permission for a locks change unless you're sure that the squatter has not rights in your state. If he is considered a tenant-at-large, then your approval will amount to a self-eviction. Get advise from a state LL association first. --71.175.xxx.x

Thanks for the comments.

Unfortunaly this has been going on for too long. The tenants seem unable to handel it.

I have not been able to find a landloard association in our area (Space Coast FL).

I guess I can get involved now and pay for the eviction, or wait and pay later; hoping that something will change in the meantime.
