If you have a non-working appliance, put in a written repair request.

Most states regulate the withholding of rent to problems that effect the habitabilty of the home, and after written notice the LL has so many days to remedy..
Best for you to look it up ..
Just doing it may be taken as a breach of the agreement
A non working garbage disposal is not a health or habitability issue..

Well, did you break them? You can only withhold rent for absence of major services like heat, water, electricity. If you broke them, then get a repair guy out and have them fixed.
If they really are worn out and landlord won't fix them and you have no reasonable alternative, then you need to move.
A garbage disposal is not a necessity and is really prone to being misused by a tenant so if your landlord is reluctant to repair it, is that because you broke it once before and he or she had to pay for the repair? --73.33.xxx.xxx |

With holding rent is going to wind up with a eviction. A garbage disposal is not a necessity. One can still recycle along with taking out the garbage. Here some municipalities garbage disposals are not allowed. A working fridge, stove, heating along plumbing is essential for living in a rental unit. A garbage disposal is not essential. Sometimes tenant abuse appliances which causes the appliance to break down or the life expectancy of the appliance is shortened. I don't know anything about SC, but most states' statutes regarding uninhabitability include all plumbing fixtures in good working order.
For example, Oregon statute 90.320 states:
For purposes of this section, a dwelling unit shall be considered unhabitable if it substantially lacks:
...
Plumbing facilities that conform to applicable law in effect at the time of installation, and maintained in good working order;

Thank You all for your responses. Although the garbage disposal is not an essential habitation tool, it does allow for fumes to escape into the kitchen, hence my discontent. My brother moved into an apartment. We visited him and he mentioned his garbage disposal wasn't working. It took about five minutes for my husband to remove the piece of bone chip that had jammed the unit.

Thats surprising.
Generally, if you market a property with a "convenience", then it goes with the property and landlord is responsible for maintenance (unless agreed upon otherwise). Tenant is not responsible unless malfunction is result of more than ordinary wear & tear.
Appliances have a useful life, and will fail after a period of time, simply from use (wear & tear). To expect tenant to be responsible for failure due to wear & tear goes against all common law definitions of tenant responsibility.
Thus, I am surprised to hear that CT (rather one of the more sophisticated states) formulates its proctice that way.
