I have a current tenant who was recently arrested for Sexual Assault/Abuse and is currently charged as a Class C Felony.

The incident did not happen on site and said tenant has not gone to court for a final conviction yet.

We rent on a month-to-month basis only.

Would a 30 day non-renewal probably be in my best interest at this point?

Thanks for the suggestion! Once a sentencing date is scheduled, if I were to have the Tenant agree to terms on a written document as far as relinquishing all ownership of the unit and all property in said unit, do anyone know if that would be suitable enough or would I still have to follow-up with the proper court filings for an eviction? --173.21.xxx.xx

2 cents.

Not knowing anything about IA LL statutes..

I'd also suggest waiting till its done..

Tenant has no 'ownership' interest in the home.

If convicted you'd first give them the typical 30 day notice..

Then if they don't comply move to evict

Your tenant has not been found guilty of anything at this point in time. Therefore, do nothing. A lot can happen between now and the end of all of this.

Don't know how your state works, and it is true that tenant has only been charged.....but tenant is month- to-month. You can end tenancy with proper notice because there is no lease involved. Criminals are not a protected class. If it is a multi- then everybody in the building already knows what he is charged with and you may lose them if you do nothing. If he gets convicted, good luck getting him out because who is going to take him? If a single family you have time on your side. I know " innocent until proven guilty", but this is a business decision. If he doesn't get convicted ( plea deal, lack of evidence, good lawyer, etc...) are you confident he is not a liability to you. --107.77.xx.xx

Me? I'd sit tight for a while and see what develops. If this is a multi keep an ear open for comments from your other residents.

If he has been officially charged they probably have a good case against him.

I'd also be upfront and direct with him. "Joe, You know that once this hits the newspapers I cannot allow you to stay. Do you have a place you can go?
