State Specific Question About: MARYLAND (MD)

I was out of town and didn't give the 30 day notice for my tenant to vacate, lease ends 3/31, can I offer a new 30 day notice of lease termination. Tenant slipped on ice but is claiming the steps were loose. I have had a problem with tenant paying the entire lease term which was a 6 month lease to try to give her a chance to improve payment history. Am I stuck with her? I went to pick up rent and there was a considerable amount of ice on steps as I almost fell, she said the steps were lose and I told her as soon as the weather breaks I would take care of it. She was off work because she was sick, then she texted me that she fell from the steps being loose and wouldn't return my text. So I went by and saw her then she said she fell because the 2nd row was loose but the first row was the row that was loose. Also the first row is 3 inches off ground. I am sure she slipped on the ice but is now going to try to say she fell due to steps being loose. I just want to end her lease because it expires on 3/31. Should I provide another 30 day notice to vacate or how should i proceed? Any help is appreciated!!!! --50.181.xx.xxx

What does your lease say about the end of the lease? Does it renew without notice, or does it end? Local laws may dictate what happens also.

There are typically 3 ways a lease is handled at the end date.

1. It ends, no notice needed, the end date is the end date and without a new lease agreement, the tenant has to move out. If this is your case, you don't need to give a notice. You may want to send a reminder to make sure the tenant is aware.

2. It renews for another term. Without notice to end the lease, it renews for anther term at the end of the first, and each subsequent term. This situation would not be ideal for you, you would have to wait for the end of the second term to end the lease.

3. It continues month-to-month. Without notice, the lease just continues on a month-to-month basis. You can give a notice to end the lease at the end of April in this situation.

So, you have to check what your lease and laws say to know your options. You may want to check with a lawyer about the notice and the slip and fall. --68.38.xxx.xxx

Thank you Kyle. The lease had a special clause.. "A six(6)month lease agreement will be signed to ensure tenant can pay rent as agreed on a bi-weekly basis and at the end of that time another lease will be signed for a year if payments are made on time. If payments are not made on time then landlord has the right to NOT renew the lease at the end of the 6 months and tenant will have to vacate the premises." I was trying to work with her. All other terms of the lease were in force and if tenant did not vacate at end of lease then it will revert to a month to a month lease and landlord can start the eviction process. Since she owes for the rest of March (bi-weekly pymt) should I accept any payments from her for April if she doesn't want to vacate? Did I make any of this clearer? Why do I feel like I am sinking...... :-( --50.181.xx.xxx
