State Specific Question About: TEXAS (TX)

I am renting a single-family house to a Section 8 tenant.

The tenant has not paid her portion of rent for months (over $400 each month).

I gave the tenant a 3-day Notice to Pay Rent or Move Out.

The current rental contract is month-to-month. I also informed Section 8 to terminate the rental contract with the tenant.

Now the tenant does not want to pay, and refuse to move out. It seems that I have to proceed with eviction.

My questions are as follows:

(1) During the eviction process (while the tenant is still living in my house), is Section 8 supposed to continue paying rent?

(2) After eviction, will this tenant be removed from the Section 8 program automatically?

I would do an eviction for unpaid rent,I do not inform section 8 so I get paid for there share till the tenant is gone,some landlords say they have to inform the office but as far as I am concerned my state law does not say any need to do so and I don't see why it matters,the only thing that matters is they haven't paid rent so an eviction gets done.Some section 8 offices will remove the tenant from section 8 once you can prove you evicted them and others do not care at all.Get an eviction attorney if you don't know how to do it properly and get rid of them. --24.92.xx.xx

Sorry to hear about your Section8 headache. I'm currently eviction a Section8 tenant as well. Based on what my lawyer told me, Federal Housing and Authority must pay rent while the tenants are still in the program and live there. That's the answer to your #1 question. For the #2, most likely they'll be kicked out of the program from violating their obligation.

In my area, Sec 8 will keep paying all the way through the eviction as long as the tenant is there. I method I have used several times with success is as follows: T

ell tenant:"Hey, you're way behind in the rent. If I evict you, you will get kicked off Section 8. Sec 8 is paying 500 of your rent every month. That's over $60,000 they are GIVING you over just the next 10 years. Do you want to throw that away? The reason there is a 10 year waiting list is because it's such a great deal for the people on it. If you move out in 5 days I won't report your eviction to Sec 8 and you can stay on the program and you have several months to find a new place."

This doesn't seem to work with people with big hoarding problems (lots of denial) or internet scam addicts ("I had to send the rent money to get $8,000 I won in a contest")

This method also works with problem people who pay on time. I say:"I've been getting complaints about your guests doing drugs and causing problems and I'm going to evict you. Yes I might lose the case in court, but if I win, you get kicked off section 8. Do you really want to risk it? Sign this notice that you are moving out in 30 days and I'll fax it to Sec 8 office today." --71.136.xxx.xxx

The best advise consider joining a landlords association where one can get advise on how deal with many situations which come up. Either go into this site or google to find a landlords association near the rentals. There needs to be a two tier approach to every problem. Evictions are costly along there can be considerable damage done to the rental unit. Look at all options. Once the rental unit becomes vacant one needs to access what the market rent will be. Generally rental housing accept programs from the government programs when vacancy rates are high. When vacancy rates are low then everyone goes for market rent units. --74.220.xxx.xxx
