State Specific Question About: MASSACHUSETTS (MA)

I have a few tenants that have to leave early due to some business reasons, so the tenants have decided to pay the remaining rent and leave a month early. This is fine with me, but how do I know if they won't just come back one day? I mean, their lease is still "active" until it expires, its just that they won't be here. Plus, I can't rent it out until the existing lease expires. What do I do? Is there something they can sign that they won't return?

They haven't left yet, but told me that they will be leaving in April after paying the rent for April . The lease expires in May 31st which is the last month, and I already collected the last month's rent from them.

Sorry, I don't know about double rent, but I just want to know how I can avoid them from returning all of a sudden since their actual lease expiration is on May 31st. --173.0.x.xxx

If you terminate their lease they don't owe you any more rent money and you can't keep their last month's rent, can you?

And if you re-rent you have to refund as well, don't you, because you can't double-dip and collect rent from two different tenants.

You need Brad's Early Lease Termination FEE, which does end the lease early but allows you to collect an ELT equal to - AHA! - one month's rent. So have them terminate their lease in April in exchange for an ELT fee of one more month's rent, which you already have. Done and Done. --173.22.xx.xx

You can't collect rent from two different residents for the same month. So if they are paying you for May, you can't rent it out to others. If they are paying the rent through the end of their lease then they do have the continued right to use the apartment. --64.197.xx.xx

I don't know MA law but I would have the tenant sign an agreement relinquishing the property and agree to refund any unused portion of their renti if you can find a replacement tenant. To me that seems fair. --108.89.xxx.xx
