State Specific Question About: NEW JERSEY (NJ)
I have read a lot of language about tenant rights on landlords not wanting to renew a lease in NJ and the statutes that go along with it. Several mention without "good cause" a landlord has to offer a new lease. Can you please provide some "good cause" examples for a landlord not renewing? If after the natural expiration the landlord wants to sell, how can one go about non renewal? --50.182.xxx.xx |

Hello,
I like both of your ideas patty and sid however NJ is pro tenant with their laws and a landlord must renew or must have good cause. I want to sell my property. I need to offer a new lease. Some options are to increase the rent, change provisions or covenants within reason and hope they don't want to renew. I cant just say I want my property back. Which seems crazy but its true...in NJ.
I've been a landlord for a long time and never had issues with a tenant like I do now over petty things, but I am ready to sell and there is a very real possibility that they will interfere with showings of the property.
I would like to hear from others that may have found good cause in their favor to non renew a lease in NJ.

I don't know about the NJ laws, but if you tell the res you are selling they often/usually leave. The alternative is agents and strangers tromping thru their house and a moveout at an unknown time.
Can you offer renewal with a giant increase?

Dear Tenant,
As you probably know, your current lease is expiring on March 30th. If you would like to remain, the rent is now (old rent + $250 per month). Also, we will be selling this property in the next month or so and will require access during all reasonable business hours to show prospective buyers. We'll be sure to give you (fill in your state law # of hour requirements) hours notice before each showing. This is a very desirable property, but since we respect your privacy we'll try to keep it to a maximum of 5 showings per week.
If you do not wish to remain as our tenant, please have all personal property removed no later than April 30th, 2015 and return keys to our office at 123 Anywhere Ave.

Thanks Sid! the selling advisement does make most tenants motivated since they don't want to deal with the showings. I've never had this problem before but I've had friends that did have a lot of interference with their tenants while trying to get showings scheduled. I have a lunch meeting with an attorney friend on Monday.

Japd,
I do not allow current tenants to interfere with my showings. Our lease spells out clearly that they agree to the showings IN ADVANCE. All I'm required to do is give the appropriate notice: 24 hours.
If I show up for an appointment and they fail to comply, they are in violation of their lease, at which point they quickly become EX-tenants.

To start with: Ignore any and all advice given above
Next: NJSA 2A:18-61.1 a-q will list the cause of actions one can bring to remove a tenant
Many attorneys in NJ are not familiar with NJ Anti-eviction act,
Be very careful what you put in writing, it could be used in court to demonstrate your real intent
changing any terms and conditions of the lease, you will bear the burned of proof in court to show the terms are reasonable and does not shrink any benefits/conditions the tenant currently enjoys
while a LL can raise rent, you still bear the burden of proof to show the rent increase is reasonable for the market and not a pretext to just to get the tenant to move --69.141.xxx.xx |

Thanks Phil, I am aware of the anti eviction laws and truth in renter info for NJ. I think what I'm looking to hear is what others have done to be successful in this kind of situation. I'm certain there are legal ways to word it and perhaps just encouraging the notice that I will need access to show while its for sale may work just as well. I also know I may need to end the current lease on the natural expiration date and create a new lease. Perhaps at that time they may not want to renew.
They also are intersted in lease with an option to buy but I know they do not have the credit or the funding. I would like to sell outright. --67.237.xx.xxx |

but that is not going to address the "showing" Issue, if they flat out refuse entry, you will need to give notice to cure and then after the notice they continue to refuse entry you can try to evict in court, but of course they could change their tune allow access but have a messy home during the showing
