State Specific Question About: PENNSYLVANIA (PA)

Anyone have experience attaching a pay check in PA? My question is - What is the process a landlord must follow in Pennsylvania to attach a tenants pay check in order to recoup unpaid rent? Also, Is it worth the trouble for $2,400.00 in unpaid rent? don --24.205.xx.x

Not sure about PA, but usually you need to get a jugement, in this case Small Claims. Then for there you just need to know the employer of the tenant and file a garnishment.

Depending on what they make and federal and local laws only so much can be garnished. You can also go after bank accounts, and other assets. Or you can hand it over to a collections agency that will do it for you, and you only pay 40% of what is collected. 60% of anything is better then nothing.

I assume you've already evicted. If you went to the magistrate with a landlord/tenant you have a money judgement. After 30 days you file with the county prothonotary then you file with the sheriff. You inform the sheriff where they work and the sheriff will garnish wages. There will be many in the sheriff's department that won't know what they are supposed to do and some will tell you that you can't garnish wages for back rent.

Total cost to try is $300+ and that gets added to the garnishment.

I have tried to garnish twice and was unsuccessful both times. Once the girl quit her job (or talked her boss into letting her go under the table) and the other time the manager outright denied the guy was an employee. Both times I had to educate the sheriff's department (Pittsburgh not a small town) that garnishment of wages for landlord/tenant was allowed. Both times I found it impossible to verify employment or track new employer due to privacy laws. Sheriff's department was not really interested in pursuing.

I would advise to make sure they have a great job and that they wouldn't walk away before I spent the money on wage garnishment. I have had better success sending the sheriff or constable to collect direct for full amount. Other option I have not tried is a bank till. I did it one time. Not sure of the cost but it wasn't cheap. My attorney handled everything. As stated above, they MUST have a long term, decent paying job that they won't walk away from. They will file something (doesn't cost them anything) and I forget what it's called to say why they don't need to pay. The sheriff then holds a hearing. Their income follows some type federal poverty guideline exemptions.

I received my judgment amount but not the attorney's fees, costs or 6% interest. Needless to say, I didn't satisfy the judgment. At some point, I'll get that extra $750 or so but at the time didn't want to expend the time, effort or money to pursue it. --72.70.xxx.xxx

PA sounds kind of hard to do a garnishment,in NY,I get a judgment and take it to the sheriff,costs me about $70 and as long as they don't quit or get fired I collect 10% of there paycheck,they can't file anything to get out of paying it. --24.92.xx.xx
