Usually you would need to get the keys from the tenant. That would be considered surrender, then you can enter.

Otherwise you need the doors left unlocked or else you need to post notice for a certain period of time before entering.

One other thing is, could you get it in writing or at least a text from the former tenant? Saying they have surrendered possession. --73.191.xx.xxx

It depends on where in the eviction process you are.

If the Tenant vacates during the __ day period of your __ Day Notice To Pay Rent Or Quit, then I document (through video camera) that the Tenant has vacated. That is, all the furniture, the big screen TV, the clothes, pots and pans, etc., are gone. Then, I take possession immediately, clean and try to find a new tenant.

If the Tenant vacates after the unlawful detainer lawsuit has been filed, I will normally wait until the Court hearing. But for me, that is pretty quick. If that is slow for you, you need to make a practical decision as to whether you wait or go in.

Check your state's abandonment laws and notices.

Long story shot,

I have been chasing for rent (she gave me the delay tactics) the past 2 months rent and finally done being Mr. nice guy, so I filed the eviction process. Now after the waiting period I went to the court house to complete (for possession)the 24hr eviction. The sheriff's office said they are backed up and will take about another 1-2 weeks!

REALY?...

So when driving by I noticed the house is completely empty. She has blocked all her info on line and will not return any of my messages for anything or give back the keys..

CAN I GO IN and clean, want to get another renter in there ASAP.

Please advise.

The only way you win is to follow thru with court, you are already paid so finish the eviction and when the judge gives you possession you may already have the unit ready to show making it easier for you to rent the unit, then you can use the court to sting the old renter for the money owed. --75.94.xxx.xxx

Finish the process and VOW I will screen and run background checks, I will serve a 3day when the rent is not paid on time and I am in charge the tenant is not!!!

You can check for damage and to secure but I would wait till the court work is done to clean. Got to get the judgement so it hits their record!! never wait to get paid it hardly ever works out. Good luck! --71.51.xx.xx
