Did you have a written agreement that says all the details including what the funds were for and what happens if he 'changes his mind'?
Common sense would say that would have become a s.deposit

I take a holding FEE, and it is non-refundable if hte persons backs out. When a lease is signed, the holding FEE becomes the security DEPOSIT. This is clearly spelled out in a written agreement at the time I take the FEE.
What kind of agreement did you have? Was it in writing? Had you signed a lease?
In most areas, it matters a lot what the amount received was. Generally, a FEE is not refundable. Often a DEPOSIT is. --23.228.xxx.xxx |
