State Specific Question About: ILLINOIS (IL)

My tenant is a month behind on rent, and I warned him that I would begin eviction proceedings if he did not pay up by a certain deadline. Well, the deadline is now past and he has been avoiding me even though we stay under the same roof (he rents a room in the house), probably by staying at a friend's place and coming back only when I'm out at work.

I can't physically serve him a 5-day notice. I could send one via registered mail, but it still requires that he receives it. Since I don't see him at all, I was wondering if IL has a procedure to establish abandonment of the unit and allow me to repossess it or force him to show himself. --192.17.xxx.x

I don't know anything about IL, but it doesn't sound that the tenant has abandoned the property. You say that he is coming back when [I'm] out at work.

Check IL law about all the ways that a 5-day notice can be served (personal service substituted service, post & mail, publication, etc.) and see if you can't find a way to get him served. Maybe you will need to hire a professional process server to catch him when you are out at work and he is home, maybe even to stake him out.

Is this your owner occupied home and you are renting a room to a guy? If that is the case, did you sign a lease with him?

You may have different rights and responsibilities than those of us renting houses and apartments. In your case, I think I would consult a lawyer.

If it were me, I think I would also change the locks on the house, since there is no telling what he will steal and sell that is yours.

Thank you, everyone, for the advice. Yes, I legally own the house and we signed a lease contract that explicitly states he rented only the room. I managed to catch hold of him the other day to serve the notice.

Still, I will consult an attorney and see what can be done if he does not abide by the notice. --192.17.xxx.xxx

If you served the 5 day (it sounds like you did), then your next step, on day 6, is to file in court.
