State Specific Question About: OHIO (OH)

have tenants that are not paying, are out of state presently, but has let someone else use the property, so the 3 day notice has gone up, but noticed that the electric meter box has been tampered with and there is electric on, this probably means one thing, tenants stop the electricity and squatter had turned electric back on, i know if dpl finds out about this they will come and pull the meter, which isn't a bad thing, but water company wont shut off the water with someone inside, which means frozen pipes, dont know how to approach this issue, eviction takes 6 weeks or more.... --76.235.xx.xxx

Get a new legal service, OH eviction should be 26-28 days since the court adopted new service - flatfee of 350-400, done for unpaid rent, stick to the simple part of the eviction. --75.94.xxx.xxx

How long has the first set of deadbeats (original non-paying tenants) been gone?

You should probably call your lawyer for the best legal advice. If you haven't read through chapter 5321 of Ohio's code, read it and print a copy too for quick reference.

I'd lay awake dreaming of changing the locks, breaking a window and then calling the cops and telling them there's been a break in at blah blah blah address. Legal? Dunno so that's why you talk to the lawyer first. The lawyer will definitely be able to tell you what you can and can't do legally. There's probably going to be some monetary pain.

isn't TENANT A still responsible to pay you and keep on utilities and keep up with the terms of the lease?

no , nobody subleased, tenant went out of state, let other family not in lease hang out I suppose, come to the conclusion, that utility companies/law, really don't give a hoot about landlords, it takes 6 weeks, cause that how far the courts are backed up, nothing I can do, and yes, probably a lawyer, even though extra cash, on top of lost rent, paying for tenants water, re-fixing all the stuff I just put in new is on me.... cant sue a turnip for blood, so it is what it is, just checking if someone had some "outside the box" idea, thanks for the replies --76.235.xx.xxx

Each State and County have different laws. When I was evicting a tenant, before our court date they moved out giving a group of homeless the keys to the house. I saw the worst of the worst junking up the property. I posted a 24 hour notice to enter and returned the next day with the police and a camera crew.

Almost all of the homeless had some type of police record and didn't want to be recorded. They ran off instead of being caught on video. Because no one was left inside and the police confirmed this, I re-keyed the locks and hired a licensed armed security to stand guard inside for $300 a day.

This only worked because my real tenant left me a voice message, "Robert we moved out but gave the keys to some friends". This may give you an idea......

Out of the box ideas? Okay, you ask for them. Btw, I do not claim that I have used these ideas, nor if these ideas are legit in your area. In fact, I'm guessing #2 probably is NOT legal and could get you in serious trouble if the tenant puts 2 and 2 together and had the guts to make a fuss. YMMV, do your own due diligence, no guarantees or warranties expressed or implied, proceed at your own risk.

1) Bribery. Cash for key. Pay them to leave. Once they are gone, you have keys, you give them cash. However much you give is up to you, but 2 weeks of rent isn't too shabby when you consider you avoid 6 weeks of lost rent plus court fees.

2) Intimidation. I read in a 'guru' book once how the guy would hire a biker gang who were Docs and attorneys during the week that just liked to get together, put on their leather jackets and chains, and go ride their Harley's on the weekends. Anyway, he bought each of them a case of their favorite beer to go park their bikes on the lawn and had a conversation with the deadbeats / squatters. Apparently the "tenants" were gone within 24 hours.

Some people respond to carrots (idea 1), some people respond to sticks (idea 2). My purpose is sharing these ideas is to promote alternative thinking. --108.250.xxx.xxx

Time to get real. I believe your leasees have flown the coop.

Clues:

-nonpayment

-"out of town"??

-elec off, probably for non pay. Call all the utils to check.

-tampered with meter

-squatters

Me? Call the real resident hoping to hear he's gone. I'd go to the house and tell the squatters to leave or I'll call the police and have them arrested for trespassing. Post an abandoned property notice on the door.

If you report the meter tampering the util will pull the meter. Your pipes will freeze but the squatters will have no heat, hopefully leave.

(You can do things to winterize and protect the house to minimize freeze damage)
