State Specific Question About: OHIO (OH)

I rented my apartment 2 months ago and now find out the tenant has 3 dogs, in spite of the written no pet policy in the rental agreement. Also extra people living in the place. I intend to give her a 30 day notice to leave at the endof this month. I've done plenty of evictions but never a 30 day notice when the rent is current. If she doesn't leave I know I would then do a 3 day notice and evict. My question is does the eviction in this case get handled the same as an eviction for non payment? I should add this is a month to month rental.

1st, give a "Notice to cure" with a deadline, perhaps 10 days.

You did not say if lease or mtm.

MTM, just a 30 day if you want them gone.

You would be evicting a hold over tenant vs non payment. It is the same process as non-payment except for the extra 30 days and your arguments in court.

If they are on a valid lease I would just file the 3 day notice and then evict. It will cost more but it will be faster and more determinate. --74.215.xx.xxx

Evictions for other reasons then non-payment of rent are more difficult. The best option is to contact a landlords association where one has to follow all the right procedures. Either go into this site for a landlords association or Google. --74.220.xxx.xxx

Without knowing your court or lease the bestway is get photos of the dogs and raise the rent retroactive to date first observed, must include in next cycle payment - animal/s already there so must go, does your area allow eviction with partial payments? What is the escrow process? Can you place the partial into escrow and use this towards damages in second cause hearing?

Extra people is hard to prove but a housing inspector once would visit the rest room and photo the toothbrushes laying around and ask who is who, then demand applications or must leave. --75.94.xxx.xxx

Ohio Notice to Quit – What should be included?

The Ohio Notice to Quit Form must contain the reason for serving the Notice to Quit and the amount of time the tenant has. The problem must be clearly stated on the notice, so the tenant has reasonable awareness and can either correct the issue, or vacate the rental property. Address of the Rental Property in Ohio

Number of days the Tenant has to correct the issue

I do know that in Ohio with a month to month rental I don't have to have any reason for telling the tenant to leave. I learned today that I just do the 30 day vacate letter (no reason given), then if they are still there at the end of 30 days I give a 3 day notice, then evict as usual. Another way I could go is if she doesn't pay February rent after receiving the 30 day vacate letter I can give the 3 day notice for nonpayment, which is easier. --69.133.x.xx

You are correct. If they don't leave after the 30 day notice and they paid for that month you are evicting as a hold over (failure to leave after receiving the 30 day notice is put on the 3 day pay or quit and eviction court form). It is probably best to have things like the leave date to correspond to the end of month to stay away from the tenant saying they paid at the beginning of the month but you are kicking them out early. --74.215.xx.xxx

Several people on this board make a point of doing a "maintenance visit" after a couple of weeks of residency (furnace filters, pipe leaks, etc.) just to be able to see how things are going. I do that now, and you should too (or your handyman) from here on out.

As for this tenant - trust your gut - she may respond to a Notice to remove the pets and extra people, but most likely not. Thirty day notice to quit!
