State Specific Question About: PENNSYLVANIA (PA)
I have 2 tenants who cosigned a lease. One had legal problems and is now in jail. She had her mother remove all her belongings from the apartment but never informed me that she was no longer living there and the remaining tenant is paying all the rent. If she is already out, what is the point of an eviction?
If your real question is "How do I get her off the lease?", I have to ask why would you want to?
If you insist, check your laws to see if her lack of presence and belongings constitutes abandonment, and if so, then write a new lease for the remaining tenant if you want.

I would consider her a tenant still,she signed the lease so still responsible.If I had to do an eviction I would put both names on the eviction docs otherwise you are still getting the rent so I wouldn't get involved --24.92.xx.xx |

What would your basis be for an eviction? The rent is still being paid, right? I think this is the kind of thing I would just ignore.
If the existing tenant moves out, you regain possession from that one, and simply proceed to fix up and re-rent.
If and when the remaining tenant stops paying rent, you evict both of them for non-payment.

Congrats on being aware of your residents! Congrats on asking a good question!
But if the rent is paid don't try to manage their lives.
The person is still a leasee and you do not have the right to remove them...unless BOTH signors ask and you agree.
We NEVER remove someone due to jail, divorce, splits, etc. because I might need them for unpaid rent.
We WILL release someone who asks when they pay the Early Lease Termination Fee, AND the remaining res can afford the rent.
Jail is not forever. Sometimes short.

One of my tenants called me the day after Christmas to tell me she was getting a divorce, her soon to be EX was gone and all of his Schtuff, and could she have his name removed from the lease or fill out a new lease. Loved that house and wanted to continue to rent it.
I knew the soon to be EX wasn't good at holding down a job for very long. She however was rock solid and had qualified on her own to begin with. I said "I'm sorry to hear that and yes, I can certainly come by with a new lease" - and then I did the Snoopy dance of joy to the printer because the right one left and I was keeping the responsible one. :-)
