State Specific Question About: FLORIDA (FL)

I have been told that you may charge a non-refundable fee (usually $250) & a monthly rent of $20 per month of pets. Does this sounds reasonable? --108.223.xxx.xxx

I state in the agreement that one cat is allowed and must be spayed or neutered. My experience is that, I tell them no pets or I charge an up front fee and then they just sneak them in so charging up front was a waste of time. I rent to folks that live check to check and then they get a cat that costs them MORE money that they don't have. Drives me nuts. I have carpet and I can usually clean the cat smell out of the carpet. --66.64.xxx.xx

You may charge whatever your market will bear (i.e. what tenants will actually pay) as long as it aligns with federal, state and local laws.

CAVEAT: some animals cannot be charged for, including professionally trained service dogs and the oft-debated 'comfort animal'. Do a search on this site to see the many discussions on that topic and what the implications are when confronted with comfort animals (aka tenants trying to get free pets).

I charge (per animal) $150 up front fee and $15 per month. Most tenants don't bat an eye. There is no need to call it non-refundable since a fee is--by definition--non-refundable. Be careful not to call it a deposit. Deposits are--by definition--refundable.

There is no such thing as a non-refundable deposit. I only mention that because once a week or so someone posts here about their non-refundable deposit. Such careless wording gets people into trouble. You've got the right wording so far, so all I might suggest is mention in your animal agreement that if the animal leaves the residence for any reason during the lease term (i.e. it dies, they give it away, etc) that no portion of the fee will be returned to the tenant. If kitty or doggie enters the residence for 1 minute, the fee is due, paid, done, end of story. Tenant needs to understand that. If they run out of beer money they may try to claim that since the critter is gone they deserve to get back part of the fee. Nope.

My official policy is also 3 animals maximum, but practically speaking no one goes over 2 because that would be $450 up front plus $45 extra per month. On my humble $450 - $500 a month rentals, that's more than most of my customers can afford. --108.250.xxx.xxx

There is nothing in the FL LL/T laws concerning Pets, pet fees and pet deposits.

Depending on who told you that, it may be the rule of thumb in your area o FL.

If that is the case most likely the local judge will up hold it.

I'm in the capital area.

I have things set up slightly differently. All my application info states "up to $300.00 or $25.00 monthly". I usually don't charge that much up front, usually half, but have it stated in the pet agreement that if your pet is causing damage to the property, the rest of the $300. is due. If you try to slip an additional animal, another full amount pet fee is due ...all "additional rent". My two favorite words! --205.223.xxx.xx

Go to their website s and see what the pro pats are getting.

We get $150 Non-Refundable Animal Registration Fee per animal plus $35 per animal additional rent.

We have MANY with 2 animals providing MUCH additional income.

No carpet makes this really easy. They don't even flinch.

2 animals is an extra $70 per month.

Animal lovers expect it.

Local apt complexes charge more and have tons of rules about weight, shots, etc. we're easy.

In KS, the max pet deposit I can charge is 1/2 month's rent. So I charge the maxiumn allowable pet deposit. I also charge $10/mon/pet for pet rent. We have a 2 pet max.

Alot of LL in the area charge a smaller pet deposit and $20/mon/pet. --165.201.xxx.xxx
