If I have a potential tenant that was charged with a Felony offense but was granted a deferred judgment can I count that charge against the tenant?

If your written criteria specify this as disqualification, then it is a disqualification. If you chose to treat this as a "felony conviction", you may do so. The only rule you have to follow is that you have to treat this applicant just as you do all others.
