Do you have cause, like nonpayment or a major lease violation?
Here is NJ almost the only reason one can use is nonpayment.

In Mass, it's called "termination of tenancy".
Is this an owner occupied building? And, if so, how many units? And where in New York is the building? As I understand it, there different laws/ordinances depending on exactly where you live, even within the boroughs of NYC. --66.19.xxx.xxx |

Raise the rent then if no payment follow what 98 percent of landlords do - unpaid rent, of course you will need to follow your local and state tenant laws so this does not cost you more than 30 days time. --75.94.xxx.xxx |

In NY, if you serve a month to month tenant with the required 30 day notice to terminate the tenancy and the tenant fails to leave, you may commence a hold over proceeding. Do not accept any rent from the tenant after the tenancy has expired if you intend to bring a hold over proceeding. You do not have to give the tenant a reason for terminating the tenancy. The lease is up, he/she must go. There will be no defense to a hold over proceeding although he/she may ask the judge for more time to find another apartment. --67.82.xxx.xx |
