Send him a letter so he has it in writing that you requested he take precautions to avoid over spray. Also take a couple of photos of him spray painting.

If he gets paint on your house or cars, you have a couple of options. Ask him to pay for the cleanup costs. If he refuses, have your lawyer ask him to pay for your cleanup costs, including a court order if needed.

Alternatively, call your insurance company and ask them about coverage. They will eventually go after your neighbor, in court if need be.

The neighbor is building his home and made the decision to place the home as close to my property as he can so that he will have space on the other side for vehicles, trailors, etc. He is spray-painting the house a barn red; I have lived here for 20 yrs and paid $12,000 to have vinyl siding put on my home and another $8,000 for coverings over both of my decks. My home is a pale yellow. He started the project in August and I have had sawdust everywhere since then...he has assured me that he will personally clean up anything, but as always, I go out every evening, clean up the trash that the contractor have left, blow the dust off of all areas under the house (I live on stilts), throw his trash back on his property, and cuse like hell. I do not have insurance since hurricane Ike hit; premiums have skyrocketed and the insurance company had all sorts of reasons for NOT PAYING then...why would I expect them to pay NOW? Red mist on yellow - a new look!

CLEANED is never as good as ORIGINAL, even if he DID clean it.

Even airless sprayers on a no-wind day send mist everywhere.

Practice self -defense in this situation. Plastic is cheap. Blue tarps are reusable. Do not expect him to take ANY precautions.

Move your cars.

I DO like the idea of a letter NOW but I's pump it up by having it sent from your atty!

Also, my attorney suggested that I get his records from the building inspector to see if there are any code violations - I am feeling so much better about this...particularly since the attorney said he can make the neighbor's life a living hell if I want to pay for it. how do you know when he is doing this?

I think I would ask him to tell you and give you written notice so you can have your property protected from over spray. Seems that is the only neighborly thing to do I would not want him on a ladder at my house putting who knows what to put up plastic or other protective covering. I think I would just do it myself but I would need to know when. Would not allow it to happen and then try and have his fix or pay to fix or sue, just take care of it and protect your property. make good neighbors, his house is very close to your property line. --70.13.xxx.xxx

The house is under construction - there are folks there every day and night...I have spoken to the goofball and he insists that there will be no overspray and if there is, he will clean it up. He hasn't cleaned up anything since the construction began, so why would I expect him to provide NOTICE. I am paying out of pocket for someone to put up plastic on my home, so that I don't have to sue or deal with this bozo...he has already crossed the line in terms of good neighbors! --98.197.xxx.xx

It occurred to me - my community requires that all buildings are at least 5 ft inside the property line on the side, with other amounts front and back. Does your community have similar Rules? Is he following them? Is he far enough inside the property line?

You said every day and night. How early and LATE? Is he breaking local rules THERE?

The last time I built, we ended up with a storm that blew debris all over. I got a call on a Monday morning to get it cleaned up right away. The port-a-potty company had to be called as well as their unit had blown over. My city inspector was was quite proactive. --67.43.xxx.xxx

I really feel for you Vicki. One reason I sold my beach house (other than the huge profit) was our homes were literally five feet apart and one neighbor was a spoiled rich brat and I was sick of dealing with him.

My current neighbors are nice enough but even with about 100 feet are pstill too close. Our next home is going to be a minimum of 40 acres, I do not want to ever see or hear a neighbor again! --24.121.xxx.xxx

So now that you know that, if you don't do something to protect your property and there is over spray (as you expect) then you become the victim ==And== if you try to change the things you can't YOU become angry and go to court. CHANGE the things you can, accept the things you can't.

Maybe the way his sprayer works and the type of paint they are using it won't get on your property, maybe painter knows what he is talking about. What's your risk level? confidence level in his words?

Notify him, tarp it yourself, take the high road and be civil.

Making his life miserable and demanding he clean up your house will not make an ounce of difference.

A neighbor decided to remodel their home next to a rental of mine. Before they began to spray on a stucco texture coat, I asked the contractor and owner to protect my driveway, my tenants cars and my side of the common fence. They did nothing to protect any area off of their property and my driveway had stucco everywhere, my tenants cars paint was damaged.

My tenant deducted the cost of a new paint job on their car from one months rent.

I wrote a letter to the contractor and to the owner of the house responsible for the damages and got no reply. Then I filed a claim with my neighbors insurance company and the contractors insurance and bond. I followed it up with three lawsuits in small claims court. The contractor, the owner and my tenant (they had car insurance that paid the damages and not paying rent wasn't fair). I won all three cases and put a lien on my neighbors house, collected from the contractors bond and got my tenants to forfeit their deposit to make up for lost rent. A lot of work over a stupid mistake on the part of the contractor. --74.100.xxx.xxx

I am thinking of a case from a different point of view. A landlord hired someone to paint a rental. The landlord made certain to get paperwork from the painter about insurance, being an independent contractor, etc.

The painter was doing OK spray painting, but didn't stop when it got windy. The neighbor was quite upset about all the little dots of paint on his house, car, etc. and complained to the landlord and threatened to sue. The landlord had enough paperwork to be covered, and referred the neighbor to the painter. I don't know if the neighbor was able to collect from the painter or not, but in any event the landlord was in the clear. --82.224.xx.xx
