State Specific Question About: NEW YORK (NY)

Hi i am a renter in western ny. i recently moved into a new apartment and 2 weeks after living there realized i had no mailbox. i was waiting for a package so i called the landlady to see if maybe i was missing something and the mailboxes were somewhere i wouldn't expect, she then told me i didn't have a mail box and that she had discussed with me that i would have to open a PO box because there wasn't one, (she had not) i then asked her if i could put in my own mailbox and she said no that was not allowed and we had discussed that as well (again, no we hadn't) i looked threw my lease and nothing is mentioned about not having a mailbox. i asked my postal service if i could just put one on the porch and they said no it has to be accessible by the road. i have no idea what to do is this even legal for her? --50.75.xxx.xxx

In rural areas having a box inside the post office is common, however other carriers will drop off inside a screen door - package theft is a big pain this time of year. --75.94.xxx.xxx

Sarah,

There are several things confusing about your post.

Item 1 - It's titled "mailbox removal". From what I can tell, your land land didn't REMOVE a mail box. There simple ISN'T one and apparently never has been. So to ask "is this even legal for her" implies she did something. Are you referring to her refusing to allow you to put up a mail box? Keep in mind there are specific requirements for putting up mailboxes...you cannot just put one up wherever you feel like it, as the post office has informed you.

Item 2 - She said / I said. Neither of you has anything in writing apparently to document the lack of mailbox.

Item 3 - I am not aware of any requirements for a land lord to provide a mail box for a residence, but there may be one. I just spent 5 minutes digging around on Google and couldn't find anything conclusive. You might try contacting your local postmaster and asking. Just remember he isn't a lawyer and may not have the legal answer, even if he does have a person OPINION on what he thinks your land lord should do.

I'm curious, what do all the OTHER tenants in your complex do to receive mail? Why not ask a few of them and see if it's the same deal (i.e. rent a PO box). If so, you may be stuck with that requirement. I agree it's a little odd not to have mailbox, but odd might not be illegal.

sorry i wasn't clear, yes there is nothing in writing documenting anything about the mailbox. but if i just put one up she will defiantly have a problem with that, she works on a very short fuse so Im trying to get this figured out before going back to her, the postmaster said i need to get one put up when i called and i told her the situation and she said that my landlady cant do that. she however is not the law so i need to figure out what to do, also, although it is slightly rural, everybody else on my street has a mailbox except for my house. also it is not a complex, it is a house. so there isn't really anybody to ask. also as a last note, i do not expect her to provide me with one, i am more than willing to buy it and put it up myself, she is stating however that i am NOT allowed to. --50.75.xxx.xxx

I live in a rural area. Our rural mailboxes are on the main road, grouped in a cluster. When we purchased our property we had no corresponding mailbox on the mailbox stand. We purchased a rural mailbox at Home Depot, labeled it with house number and viola! - mail started appearing in the mailbox. That being said, we also have a PO Box as mail theft is rampant in our area.

It's odd. Maybe your landlady has dealt with people not changing their address or I wonder if she has more apartments than the house is zoned for? You said you moved to an apartment, but it's a house. Are there apartments in a house, and if so, how many?

What do the other tenants do?

well it is an upstairs and a downstairs, i have the lower apt while an elderly man is occupying the upstairs. only problem is he moved there a week after me so hes even newer to the house than I and also doesn't know what should be done. --50.75.xxx.xxx

Go to the Post Office and speak with the supervisor.

Ask what specific regulation in the The USPS Domestic Mail Manual controls the placement of mailboxes for your address.

If the Manual shows that there should be a mailbox on the property,

present this information to your landlord and ask her to comply with the regulation.

I was thinking the same as Jane(FL).

Sounds like an illegal apts., not zone for duplexes or multi-family units.

Two mail boxes would be a dead give away.

Ride around your neighborhood and see if there are dual mailboxes on some of the properties. --205.223.xxx.xx
