who has the responsibilty of repair of bathroom floor from water damage where the tenants caused damage. we did checklist when they moved in 4 years ago the floor was in perfect condition, now the floor is rotting and I feel that is neglect on there part --96.231.xxx.xxx |

For a four year tenant it may be normal wear and tear and on your pocket book. Did tenant do something, like not tuck in the shower curtain and water went on the floor? Our structures fail sometimes, it's not always tenant, Think about your own home. --184.215.xxx.xxx |

"Feeling" that there is neglect is not enough. You will need a judge to share your feeling, and that will (should) be dependent on demonstrating that the tenant is legally responsible.

Often this is going difficult to prove. It is better to repair the floor along with installing a floor drain if possible then amortize the cost of repair over a period of time maybe five years then when possible increase the rent to cover the cost of repairs and upgrades. Put down a Schluter ditra membrane then install a good quality of porcelain or ceramic tiles then make sure everything is waterproof by having the membrane at least 6" on the wall. With rentals one has to prepare for the worst case not the best case. Often at the Habitat for Humanity restores it is possible to buy enough tiles for a very reasonable price. --74.220.xxx.xxx |

thank all of you for your input, it is so helpful to be able to reach out to people who have gone thru these same problems for advice. I told them that it was their responsibility and that was that, but I would allow their friend that is in the business to do the work to save them money and reminded them that most landlords would just send a company out and then bill them, which could cost a lot more. After I had read all of your opinions I decided to call and ask if they understood why it was there resposibility. she felt that the crawspace held dampness that caused the problem, I felt that water standing on floor caused the problem. Not knowing who is right for sure I decided to split the cost and she was very happy with that. Sometimes you have got to eat a little. they are happy being there, and after all it is thanksgiving week.So thank you all once more for keeping me straight and Happy Thanksgiving. --96.231.xxx.xxx |
