If we have a denial and the applicate disputes it, do we need to wait, or can we go ahead with the next applicant? A denial shouldn't hold up the process. --209.117.xxx.xx

Hi Sue.. .and you've a common question..

The situation you suggest would not or does not delay your continued search for the best qualified applicant.

I'd searched in 2010 for a clarification of the commonly held method of 1st come gets it'

Part of the reply from HUD regional was;

'Although we strongly recommend that landlords accept the first qualified applicant', fair housing law does not require this.

'Landlords are allowed to adopt whatever'.. 'method of picking a qualified applicant..... (as long as it is not discriminatory)

'Landlords have the liberty of accepting a group of applications' and 'screening' through them for the one they like best.

Simply tell them to submit their request in writing within 30 days and you will never hear from them again. If your denial was based on a valid, non-discriminatory reason, you have no reason for concern. But, you shouldn't tell them anything because anything you say could be taken out of context and/or (mis)interpreted by an attorney or tenant advocacy group. --70.92.xxx.xxx
