State Specific Question About: MASSACHUSETTS (MA)
Can a tenant rent withhold as s defense in MA?
Timeline: served a 30 day notice. tenant called board of health.
we corrected issues. after 30 day expired we served summary process. tenant now owes 2 months rent plus court costs. Tenant is saying issue not fixed. Court is this week. I have letter of compliance from BOH thanks --74.104.xxx.xx |

I'd bet.. (no pun) that there is a process in MA statue on withholding rent..
In your rental contract there may be or should be

Bet, MA laws Chapter 239 Section 8A spell out what a tenant must do to legally withhold rent. One of the key conditions is they must not be behind in their rent before the legal rent withholding begins.

I learned years ago that the tenant must give their withheld rent to the Housing Court to escrow. But alas, the Housing Court agrees that this is supposed to be done but says they are not set up to actually do that! So, once again, the LL is SOL. --73.186.xx.xxx |

Judge will see right through their scam. You did what you were supposed to do and fixed the problem. Timing is key here. You served 30 day before they called BOH. They can't claim retaliation. Next time they will call Boh before they get the 30 day.judge will make them pay. --24.177.xxx.xx |
