State Specific Question About: ILLINOIS (IL)
I have a single tenant that has been at my building for almost 3 years. She's on disability because she's terminally ill. Sadly, I think she's near death since she's taken a turn for the worse. Anyway, has anyone been in a situation like this? Her lease doesn't expire until at least 6 months. I have her family's contact information, etc. but I'm wondering if I should be doing something else to cover myself legally. --38.104.xx.xxx |

It is not easy as this is unfortunate situation. Try to contact a landlords association to see what can be done. Here they have places where people stay until they pass away. They receive care but there is no hope they will recover. --74.220.xxx.xxx |

Make sure she has a will and you know who the executor is for the estate. Once she passes do not let anyone in the house other than the executor.

It is a very sad situation. In addition to knowing (if any) who the executor is also try to know who the health care proxy is too. This person makes all healthcare decisions for the patient if she reaches incapacity and the one most likely to keep you updated and prepared. God bless. --98.24.xx.xx |

Hi Fran...
First thanks for sharing... we all learn from the actions of others..
You'd mentioned you had the info for contact in the family..
two suggestions;
1. Check IL.. statutes see if they address a tenants death.. and what you'd need to do or not do....
2. As spacey suggested.. control access if you can..
however the several times I've had it happen.. seems I'm the last do know...
3. contact the family in preparation.. let them know you want to be of service.. then of course ask who is the contact or in charge legally..
4. From a business standpoint you want the house back without having to move stuff or clean it..

I would not be asking her if she has a will or who the executor is,it is none of the landlords business and I think it would just upset her.I wouldn't call the family ahead of time either.If a family member or friend has a key and cleans the place out it is not the landlords problem.Chances are very unlikely she has a will,executor or any plans,tenants simply don't have enough assets to be concerned about things like that. --24.92.xx.xx |

Talk to her not this group. Stop by with some flowers or some chicken soup. Ask what you can do for her or if she needs anything. That will start the conversation and perhaps answer your questions.

I'm with AllyM on this one.
"Is there anything I can do to help? Maybe help with the apartment?" is a great lead in.
Communication is key right now. Some people WANT to take care of things before they go. Sometimes it's easier to talk to a non-family member than someone close.
For the record when I am this ill, I want someone to help make sure things go smoothly after I'm gone.

Another if this helps: I am learning about "chemo brain". A common condition. With so many drugs in the body the thinking processes get messed up. Sometimes helps to quietly and slowly talk thru things, with reminders. --67.175.xx.xxx |
