State Specific Question About: FLORIDA (FL)

I have this tenant for the most part she pays on time

She's a Senior, Her son works with my wife. He stays there

with her from time and I'm all right with it because he helps her out, not with payment but with other things. Occasionally his kids stay over there during the summer my place is only a 2/1, 800 S/F. I reluctantly tolerate it because it's not as frequent as it use to be, but now she's allowing some one whom I never seen him before stay there and it isn't a significant other. He appears to be a Nephew are some other young man that maybe related I would assume. My wife is saying I should let it go but for some reason this annoys me, should I listen to my wife and ignore are take other action? one being charge a Fee.

Well I'd say your first choice is to determine why it bothers you?

I'd would bother me as well..

you made an agreement that it would be only her living there..

You allowed apparently others to stay there without question.. or noted explanation from her..

So what is different about the 2nd fellow.. ?

Tell us what your agreement says about guests?

These are folks not on the agreement.

Tell us what your agreement says about

'waiver of terms'... if anything..

That is you waived the term for exclusive occupancy.. but in doing so.. you do not loose your ability to ask for or demand adherence to the agreement.

This is one of those fundamental challenges of being a LL. And it doesn't just apply to guests, it could apply to extra vehicles parking in the parking lot or up on jacks being repaired, or late rent, etc. There's a saying that once a camel's nose is in the tent, here comes the rest soon to follow. It's even tougher when it's a tenant you respect and like.

When there's a violation that you will tolerate, I recommend you put an exception in writing. Provide a time limit to the exception. Make sure it states that you are not waiving your right to enforce the rental agreement and that it is a temporary situation.

Please be aware that some will say to not tolerate any deviation from the rental agreement or rules from anyone. This is the safest position to defend. If push comes to shove, the tenant will turn to their best interest, not yours. --166.70.xxx.xxx

Hello To My Respondents:

First I would like to thank you all getting back with me so quickly! I have and all "INCLUSIVE RENTAL AGREEMENT"

and it coverers all of what you were asking. It so stipulates that only the tenants who are listed on the agreement has the right to occupy the property. I was informed after the fact that his daughter and son would occasionally be there. The daughter was 15 and the son was 17 at the time, this was 2yr's ago. After the first year the

son enlisted in the army the daughter was still there periodically to look after her grand mother who has legal rights there. The reason why It bothers me so much about this young man is one I wasn't informed, and I have know Idea who he is. He appears to be about 23-24 years old. And own a car that's parked all over the front yard out side of the front fenced. I gave my tenant a discount of 15 percent rent to help her out she was in dyer need at the time from $750.00 from what I normally get to $650.00 per month circumstances I want get into. It just doesn't feel right that I should do all the sacrificing, and then let some out sider take advantage of the situation and live in my place for nothing. I've decided to approach my tenant

and find out whats going on and I may apply and additional Fee for anyone over the age od 17, approximately $50.00 dollars per week are $100.00 dollars per month.

I know I got a little long but please advise me of my rights as to weather this is possible.

Lawn parking is a 200bux repair cost at any of my places, we loan out 2x12 for the moving van, unauthorized occupants cost 50bux each monthly, we do allow the grandpa summer vacation of 14 days in any 100 as the max time allowed to be a house rules visitor, you need to alert the tenant of the lawn repair bill coming - include this in the next month rent and any occupant fees. --75.94.xxx.xxx
