State Specific Question About: MAINE (ME)
I had a tenant who had a Siberian Husky and a cat rent from me and prior to their move in date, I had new carpets installed in the upstairs bedroom, hall, stairs and landing and also received a $500 pet deposit plus one month's rent deposit. Upon vacating the property, the master bedroom, stairs, hall and landing were ruined due to dog where the dog laid (with no dog bed) in the master bedroom and landing, etc. - I had a carpet installer, as well as a third party assess the carpet and the odor was so bad and stated that even if the carpet was professionally cleaned, that there were no guarantees that the odor would come out because it went into the pad and the terminology that was used was "wicking" in which even if you clean it and it becomes hot or moisture set in, that the smell will continue to come up and the only recourse would be to have it replaced. Thankfully it did not get into the floor boards, otherwise I would have had to sealcoat that as well. I gave them a partial refund of $690.00 as the cost for replacement was $1,700 but the second bedroom was not compromised to deducted that - so it was $1,100 total so I kept the pet deposit and deducted the balance out of their security deposit and now they are suing me for withholding a part of their security deposit when clearly it was not repairable. Did you take ALOT of pictures of the damage? Also- get your carpet/repair people to write in as much detail as possible the who, what & why on their invoice to you. It might read "replace carpet & pad at 123 main st due to animal damages". ALSO- if you have any before move in pictures they would help you prove that the place was perfect before they moved in. --98.89.xx.xxx |

Are they ACTUALLY suing you or just threatening? Big difference! Lots of tenants threaten, few follow through unless they really do believe they are owed the refund.
If ACTUALLY suing you, did you properly document to them WHY you withheld for damages? And can you get your carpet people to back you up? And of course you have receipts for the original install and the replacement? --50.82.xxx.x |

Lots of chatter but little suing ever takes place, photos will be your friend in court if it goes there, there is a 84 month formula for carpet wear but I have not used it for years and forget how this takes effect. --75.94.xxx.xxx |

Do you have the receipts for the carpet?
Did the tenant sign a move in inspection?
Are there other costs you can legitimately add ? If so I would thank the tenant for contacting you and send them an additional bill. My guess is they wont pursue it further and if they do.......I would ask for every single penny of damages they caused. (including costs such as mileage, fax, estimate costs, lost rent, a reasonable hourly rate to research carpet cleaning/replacement options, meeting with contractors, shopping for replacement carpet, disposal fees ect ect. )

How long were the tenants there? The carpet was new when they moved in?
I just to Court for the first time this year and the carpeting was one of the issues. Judge asked the age of the carpet and how long the tenants lived in the house.
