State Specific Question About: GEORGIA (GA)

Hi Guys.........really need your help. My outstanding tenant who just moved in one month ago is complaining about horrible tenants that live on the other side of the building. Her complaints are very accurate as these partying tenants moved into their condo about three months before I left and I complained to my HOA about them continually. On top of that, last night she heard what she thought were gunshots shortly after they stopped partying in the parking lot at 3am. The issue is that they come home between 2am - 5am several nights a week and party in the parking lot --- which is adjacent to the bedroom area of my unit. Apparently, they are bartenders and are always intoxicated.

This has been ongoing for 3 months. I know that the tenants were given a warning and the owner served a violation notice. Per the HOA manager, the owner is concerned and has been working on getting them to stop their antics.

Can we force the owner to evict? I'm hoping she will on her own but don't know for sure. My tenant is great and I don't want to lose her.

Condos are hard. Takes the HOA forever to take positive action. When we first rented a condo in San Diego when my SO was in college there was a weekend party unit across the hall.

Dead quiet all week then Fri-Sun insanity. It didn't bother us at first as we were gone on weekends. Then several times the police showed up. Then one night they were loud at 11pm. I went over and asked them to be quiet. Ok. Then at 1 am I wake up to throbbing music.

I went across the hall in a night gown with bed head and smoke coming out my ears! I slammed my hand on the door hard enough to shake the building! They came to the door and I went off! I forget the specifics, but I am very loud and at the top of my lungs I threatened to throw everyone off the 4th floor porch. The shock shut them up.

The next day nine of us threatened to file a quiet enj9oyment suit against the owner and HOA. That Friday night about 10 pm I heard noise and looked out. They had friends and were tossing everything in trash bags and nearly running out of the unit. They were gone in an hour. I called security and asked the guard to not stop them even though it was after hours, but to be sure they didn't start a fire.

I then rented the unit and left it vacant. Eventually we used it as a guest house, then my Mom moved in for about 18 months.

You may have to file a lawsuit. --24.156.xx.xx

My understanding is that calling the cops and getting police reports can help put pressure on the landlord. So presumably would help with getting the HOA to take effective action. --64.223.xxx.xxx

Hi Guys,

Thanks so much....that is exactly what we are going to do. Just got off the phone with the local police department. I wish my tenant wouldn't have to wait to be woken up to start this process, but apparently unless we have police backing it will be harder to do.
