State Specific Question About: NEW MEXICO (NM)

I am considering selling my rental property but would like to keep it rented while it is on the market. Can landlords include a statement in their rental agreement that would allow the termination of the lease if the rental property were sold? --174.28.xx.xxx

Check you local landlord/tenant regulations. In some areas, such as mine, a lease cant be terminated just because the property is being sold. --99.250.xx.x

Bert,

I am assuming this is a single family home, suitable for an owner/occupant. A month to month lease would be to your benefit in this situation.

MY suggestion: empty will sell MUCH faster. Your prospects will NOT want to kick another family out. Your residents may not have the home :nice" and will slow down the action scheduling appointments, etc. Your residents might say something to scare away your buyers.

Wait to market this in the spring (April) when buyers are plentiful and homes move quickly. Your PRO agent will know the perfect moment to make the offering public. Prep the paperwork etc in March.

Give your resident cash to encourage him to leave, freshen up the curb appeal and paint the interior so it will sell quickly.

Interview tons of agents before listing - ONLY list with a PRO who will be aggressive about getting it sold. NOT with your friend's wife who just got her license.

If you are signing a lease now, set it to expire March 31.

My big tip: pay to have your home professionally inspected NOW. Your buyer will have it inspected, so get a headstart on this and fix anything the inspector finds. I have him come back to re-inspect and give me a pretty, clean report. We market the house as "Passed Inspection".

I do the same with an appraisal. "Selling under appraised value for quick sale". Cash buyers like that stuff!
