State Specific Question About: NEW HAMPSHIRE (NH)

I am a new landlord and would like to know the law on a most unusual situation with a very unusual tenant :/

To make a long story short. There was a leak on the historic district's communal water line that took a while to fix despite doing everything we could as landlords to help the water commissioner fix the problem. They couldn't locate the leak. The tenant states the problem started in November but didn't tell us until I checked in on him in mid aug. It took until the end of this September to locate and fix the leak. I do believe he could have made a habitability case and moved out without repercussion when the water issue existed. However, he didn't ask to move, and we gave him the discounts on rent and noted they were good until problem fixed. Now the leak is totally fixed he says he doesn't want to relinquish his discount because it was very aweful time for him and if we demand he pay more his attorney told him he can still move out without financial responsibility due to the "prior" habitability issue. The problem is fixed. Is he really allowed to move out "now" with out penalty because of a prior breach? Thank you!! I feel like i am being extorted. --71.161.xxx.xxx

Tell him he has to pay regular rent and he can sue the water department for any damages he feels he encountered and maybe you can also for lost income. Not that I am a big advocate of litigation as the lawyer who gets a third is the big winner, but I think this is how everyone would become whole if they wanted to.

Maybe I am misunderstanding, but if this water issue was municipal, and not strictly a problem on the property, why did you need to offer a discount? The problem was not of your making, nor your responsibility to fix. Who is going to give me a discount on my mortgage if there is an issue with the water in my home, even if the issue does not originate on my property?

Always love how tenants think they are immune to issues that homeowners face. Electricity out, leaking roof, heat goes out, etc. Things don't get magically fixed faster than the landlord can get a competent repair person. --134.179.xxx.xxx

Correct- it was municipal, and not strictly on my property but the problem resulted in a significant decrease in water pressure so he frequently didn't have running water. If it was "inhabitable" he could have moved out without financial responsibility. He could have negotiated for many things but he really didn't ask for that much. Now it is fixed, he believes the former breach allows him freedom to move out without penality if I don't accomadate him further. I think he missed his window of negotiation as the problem is fixed and habitable. Thank you. Please let me know if i am incorrect.
