State Specific Question About: VIRGINIA (VA)

Hello, a couple applied my rental property. their credit and income seem fine. They have two adult sons living with them (and will move together with them). One son has following criminal records: POSS.OF CONTROLLED SUBSTANCE, DESTRUCT PROP W/INTENT, MALICIOUS WOUNDING, etc . should I take them considering I am signing lease with the couple. No - all adults living at the property must be screen and sign the lease. Son with record would not pass so group does not pass.

Now this has happened before. Mom and Dad rent a place for their sons to live and never move in.

Are you kidding? No way, no how, never, ever, ever would rent to this family. Read the thread from last week titled "Should I Allow This?" to find out some reasons why this would be a bad idea, other than what I'm going to say below.

Malicious wounding is a very serious thing. For all intents, it is an assault and battery where the victim is very badly hurt. In the state of Virginia, in order to prove malicious wounding (and it was proved if the guy was convicted), the all following must apply:

"(1) the defendant must have shot, stabbed, cut, wounded, or caused bodily injury to another person,

(2) the defendant must have intended to maim, disfigure, disable or kill the other person at the time he committed the act,

(3) the defendant must have done the act with malice, and

(4) the other person must have suffered severe injures with permanent and permanent physical impairment as a result of the act.

That's the law in Virginia. Honestly, Google it. How could you even think of renting to a family with a member with this record? Setting aside the destruction of property (which I wouldn't) and the possession of a controlled substance (again, I wouldn't) just a charge of malicious wounding (not even a conviction) would be enough for me to refuse them.

IMO, a landlord would have to be certifiably crazy to rent to them! I don't care what kind of sob story they might spin, or what excuses or explanations they might offer, this one is an absolute no brainer for me! --173.81.xx.xxx

By the way, I wouldn't even rent to the parents! If you do, the sons will be over their visiting. Frankly, if you rent to the couple, the sons will probably move in anyway, even if they aren't on the lease.

Can you imagine trying to evict them with a son with that kind of a record? Please, please don't rent to them. I don't care what their credit score is or how nice they seem. I think you will end up regretting it. --173.81.xx.xxx
