State Specific Question About: MASSACHUSETTS (MA)

How long should a "guest" be allowed to stay in our tenants apartment before we can force them to apply as a tenant and, or, pay us some kind of additional rent?

Also, how do you legally "evict" or eject such a guest? Thank you.

There isn't any set time frame or answer for this. It all depends upon what your rental agreement says. Is this a MTM or term lease tenancy? --72.74.xxx.xx

John...

There may also be a MA statute regarding when a tenancy is created...by length of stay or receiving mail or have utilities in their name...

My guess is there are such statutes..

The rental agreement is secondary...

Maybe start with a talk with the tenant...as they are the ones that allow this... --207.55.xxx.xxx

Talk to the tenant,it is not uncommon for the tenant to tell me they want them to move but need me to be the bad guy,OK no problem tell them I said they move or I will kick everyone out and that actually works quite often. --24.92.xx.xx

My lease says 3 days.

No comment on how I enforce it.
