State Specific Question About: CALIFORNIA (CA)

I'm purging files and was wondering how long to keep tenant applications -for those applicants that did not end up renting from me.

I saw an attorney's column that says

"A disgruntled applicant who believes that you have discriminated against him may file a complaint with the Department of Housing and Urban Development or the California Department of Fair Employment and Housing within one year of the discriminatory act taking place. "

How long do you keep old applications? Why?

Have you ever had an applicant try to sue you for discrimination after 1 year ?

I always kept applications for ten years until my attorney told me five years is sufficient. I split the difference and now keep them for seven years.

I've been threatened with a lawsuit several times but have never been sued for discrimination even though I will not rent to someone who does not speak English which is considered discriminatory by some people. --70.92.xxx.xxx

My attorney says 5 years. I think the statute of limitations is 4 years. If an applicant is going to take any action it is usually within one year unless the applicant gets wind other applicants are going after that landlord.

I like to keep them for reference in case I get a repeat application from the same individual(s). I have had that happen and the information changes as far as previous landlords, dates at address's and length of time on the job. --75.79.xxx.xx

I just retain water.

'Purging' and 'attorney columns' don't sound good together.

We keep the original, and scan our notes, CR's etc so they are here forever.

I still have all of them from when I started in the biz in 2005. The day I delete/shred them is the day I will need them.

Digital storage is cheap: buy a $50 scanner, digitize them and back them up somewhere away from home. Do it once, rest easy for life. Or pay your enterprising niece, nephew, son, daughter, child, kid-from-church, neighborhood Boy Scout, etc. $10 an hour to do it for you while you sit back and sip a cool beverage of choice. --108.250.xxx.xxx

I have applications back to the beginning. I find several people have applied for multiple houses of mine through the years. It's helpful to go back and see the notes I've made to myself (on stickynotes with the app)... It's useful in a small, isolated town; might be of less use in a larger city with a larger tenant pool. --64.72.xx.xxx

At a Fair Housing seminar, we were advised to keep them 3 years. It was also pointed out that any notes on the app itself are subject to scrutiny. Sticky notes are a good idea! --50.82.xxx.x
