State Specific Question About: WASHINGTON (WA)

My rental house has a 27 year vinyl floor that by law has been completely depreciated. It was still in OK shape to a point that we would of not replaced in with the a tenant turnover. The most recent tenant moved out after 8 years and left a big red mark from the sun bleaching a rug. Its 2feet by 3 feet big. Can I charge her for any of the replacement realizing the cost of a the total replacement floor is out of the question.

I am wondering if it could be cleaned. Bleach, Iron Out(rust remover), 409, solvents(paint thinner, denatured alcohol). Hard to tell without a picture.

Maybe cover with a throw rug, and charge them for the rug. Just an idea. Get creative.

If a tenant breaks a window, do you charge them for the new window(yes) or some fraction of it based on age(no)?

The red spot was actually bigger but she did use a cleaner to get it down to the worst 2' x 3' spot which is permanent. Putting a rug over it is not in the cards. The question remains - What kind of compensation can I charge her "damage deposit" knowing the floor needs to be replaced. --131.191.x.xxx

I wish that was true in Washington State - that is to charge her for a new installation but even on a personal level that is not reasonable. The floor was built with the house 27 years ago. We thought that since she lived there for 8 years we could use that as a depreciation factor(year 19 thru year 27)and charge her for eight years of depreciation using the new floor cost as the basis for the new depreciation schedule. Other than that I really don't know what to do.

My thoughts regarding treating depreciated assets as worthless:

If my rental house I owned for 27.5 years burns down, it's fully depreciated. Assume for the moment that any capital improvements made over the years have also depreciated. Why would I expect my insurance company to pay me anything? The answer is that the building still does have value when measured as an asset, as do the bits and pieces that make it up, such as floors, windows, 2x4s, shingles, etc.

Depreciation is a TAX concept. Therefore, I charge for damages to portions of the assets that have value.

If we go to court, the judge might decide to lower it later, but if I ask for nothing I receive nothing. Let the judge disallow me from charging it if he or she wishes. I'm in the business for me, not quasi-tax accounting "fairness" to destructive tenants.

Well looks like we are 1/2 and 1/2. Some people say: Just replace it yourself because its done its duty and those who say sue the Bitc... I really don't want to go to court but I do think she should lose a proposal amount of her deposit based on some sound and legal precedence considered a devalued worth. So thanks everyone. I'm with Ally. I'm liking the individual tiles or Allure these days. You can change out only the damaged part. Of course, 27 years is a good, long run. I'd charge some nominal amount, like $200,if she damaged it, and get a new floor. --50.129.x.xxx
