I have a four family rental in New York. I have evidence that new tenant is renting her apartment out as a vacation rental for short term stays. This a is a clear violation of the lease not to mention illegal in the state on New York. I've spoken to tenant and explained what a safety issue this with different people having entry keys to the building that are not on the lease. What are the first steps that I should take for eviction due to the violation of the lease. Also are they entitled to security since they violated the the lease. Thanks in advance

The answers are specific to NY, so you need a NY person to give you the answers that fit your situation. Also sometimes a city will have its own additional rules.

It is not illegal although it may be against the terms of your lease.You will need to give a 30 day notice to vacate before the first of September which will be effective for the first of October,then if they are not out you can evict.The cops won't do anything,they are not trespassing because they were given keys by someone with the right to be there --24.92.xx.xx |

OK, you warned the tenant. Now you don't jump right into an eviction because that will cost you a ton of money and an empty apartment. If you are not in need of money and want to punish this person for having such nerve, or an enterprising, capitalistic head, then go for it.
But I would let the warning sink in and proceed with collecting the rent from the person until such a time as I see they are doing this again. If the person does not live there and just rented your apartment to make money, however, off with their heads, or just evict them, it's less messy.
I was just speaking with someone, though I can't remember who, and this person told me that they had a rental in NYC and they didn't need it anymore but it was really handy for the family to stay there now and then and see some Broadway shows and do business and so they were keeping it. Make sure that this more innocent thing is not what is happening in your building.

Not just a safety issue David, but an insurance issue, too.
Vacation rental insurance rates are higher for a reason. I am willing to bet that your policy covers your RESIDENTIAL RENTAL UNIT, not your vacation rental unit.
I, too have had several tenants try stuff like this behind my back, they know what they are doing and just hope you won't find out. They don't care that they are putting you at risk.
