I am selling my house and my tenat has a month to month lease however, they may extend for six more months. If the house sells can they opt-put of the lease with the new owner? --139.161.x.xx |

Vee beat me to the question, but I hope this helps. If this is a true M2M tenant, the agreement doesn't extend beyond the end of next month if the tenant is served a one-month Notice to Vacate effective Sept. 30th. That notice would have to be served on or before Sept. 1st. If this is a written 6 month lease with a termination date 6 months out, the new owner would have to honor the lease as if s/he wrote it and signed it. --70.92.xxx.xxx |

I see A LOT of sales fall thru. I recommend waiting to give your resident his 30 day notice until you actually close.
I recently sold a flip 3 times before it closed.
One in the works right now has taken 6 weeks.

Thanks for the info. The tenants extended and signed a six month lease and allowed the house to remain on the market. We put in the lease they can opt- out if the house sold. They understand the new owner would have to honor the lease if they did not take the option to exit the lease. I just want the house to sell at this point. --70.195.xxx.xxx |
