State Specific Question About: FLORIDA (FL)
So, after 4 years of an argumentitive tenant, that had a grease fire and has not fixed it, really really fithy, and now she tells me she has mold, so I look at it and it excessive. So I gave her a 30 day notice.
Now I get a letter from the city of Jacksonville, FL telling me I am in violation of city code. Hmmm. I file the eviction papers August. The city gave me until Aug 21 to fix the mold. Is time on my side??

What is the city complaint involve? Mold is typically a housekeeping issue, the inspector will likely ask the tenant if he/she is allergic to any chemicals - they typically answer -no- so the inspector then shows them how to use a 1-2 percent bleach to clean with as this will greatly reduce any mildew forming which if neglected for several months -could- form mold. --75.94.xxx.xxx |

In Los Angeles if a landlord attempts to evict a tenant when a unit has an issue -- all a tenant has to do is call the City. The City will issue a violation and the tenant will take a copy with them to eviction court and the judge will "stop the eviction" until the landlord fixes the problem and get's the City's okay upon re-inspection.
I rented a unit with new carpeting. The tenant signed upon the move-in inspection they had new carpet in perfect condition. I had pictures that were time and date stamped along with my invoice and cancelled check fro the carpet company.
My tenant stop paying rent and I begun an eviction. The tenant called the City and showed up in court with a violation, they needed new carpet. I hadn't received my copy yet. But I still had my file and showed the Judge my proof, they tenant had destroyed their carpet within a 2 year time frame. Was not normal wear and tear. I was still ordered to replace it again in order to evict.
The next day I had the carpet replaced and paid the City an extra $250 dollars for a special inspection. Two weeks later the inspector from the violation came to inspect and wrote down, carpet still in bad condition. In two weeks time the tenants destroyed the new carpet to avoid eviction again.
So the next we were back in the eviction court and the City Violation inspector testified the carpet is still trashed. I then had my Special Inspector and the owner of the Carpet company testify that the carpet was replaced with new goods and the tenants deliberately destroyed it, again.
At that point I put my City on notice, that I have proof that a reasonable person, jury or judge would believe, like there was new carpet upon a tenancy (checks, invoices, pictures and signed statement from the tenant, I will not replace something again just so I can evict. Instead I will sue the City, withhold my property taxes and go to the media.
Now when I am evicting I put my City on high alert, don't mess with me, I'm out for blood.....
When I install laminate now instead of carpet, I pull a permit to memorialize the flooring is new to a tenancy. This is something a tenant can't fight..... A landlord paying an extra fee and having an inspection when not necessary.

Ca thank you, that is what I was wondering, how they can fight it.
The mold is bad, and by the looks of the rest of the house she has never done any cleaning. The drywall needs to come out, but if I have to fix it just to show the city then it will be a bleach wipe down, a very strong bleach wipe down.

Something that I do is something all owners should do. When I get an order from building inspection, I immediately call the inspector who signed the order. That shows willingness to comply with reasonable orders which goes a long way. But, you will also be able to ask what specifically is expected of you. And, you can discuss other acceptable options as well as request additional time to comply if necessary.
As for the mold, generally less than 10% of mold is actually toxic and can easily be killed with a 50/50 water/bleach solution. Unless the drywall has been damaged by the moisture, you can usually seal and repaint. --70.92.xxx.xxx |

One needs to tear out the drywall then put in mold resistant drywall then paint with a good oil base or alkyd base paint. Once that is done then procede with the eviction. Always keep the rental unit within the building and fire code. With bathrooms it is better to put a timer connected to the light and exhaust so every time they are in the bathroom the exhaust extracts the humidity. For kitchens it is recommended that the exhaust hood exhausts outside to bring down the humidity. If there is clothes dryer make sure the exhaust is clean and all the air is being exhausted outside. Changing out the shower heads to low flow also minimizes humidity in the bathroom. Start by making all the repairs as the repairs will have to be done before the new tenant moves in. Take pictures before and after the repairs are done then contact the building inspector to have the violation written off. Then procede with the eviction or collecting the arrears of rent. --74.220.xxx.xx |
